Dear Mr. Smith:
This correspondence is in reference to your letter of April 25, 2000 whereby you voiced
concern over a boatlift project by your neighbor Mr. Jerry Fesmire. The proposed
project site is located at 125 Loblolly Drive on a manmade canal off Bogue Sound, in the
Town of Pine Knoll Shores, Carteret County. The project involves the construction of a
4' X 6' skiff/jet-ski lift. The lift would be located at least 20' from the property line.
The North Carolina Division of Coastal Management has given your concerns careful
consideration and has determined that the Fesmire project is consistent with the pertinent
regulations of the Division. Therefore, the Division issued CAMA General Permit
#25572-C to Mr. Fesmire on May 11, 2000.
If you wish to appeal the Fesmire permit decision, you may file a request with the
Director of the Division of Coastal Management, Department of Environment and
Natural Resources within 20 days of the permit decision. I have enclosed a copy of the
permit and pertinent regulations for your review. If you have any questions regarding
this matter, please don't hesitate to contact me at my Morehead City Office (252-808-
2808).

To Whom It May Concern:
On April 24, 2000, I received the attached statement and proposed development plan from Mr. Jerry
Fesmire of 125 Loblolly Drive, Pine Knoll Shores. Mr. Fesmire's property adjoins a lot that I own and
plan to develop. Although I cannot state that I am opposed to Mr. Fesmire's plan, I must ask that approval
be deferred until I have the opportunity to review "in -person" the scope of the work, and the projected
results, of the plan. Mr. Fesmire and I have not discussed his plan, so I have difficulty visualizing just how
close to my property the structure will be, whether it will obstruct our view of the canal, and whether
operation of the hoist will create noise pollution.
Since we live in far southwest Virginia, we do not have the opportunity to visit Pine Knoll Shores often.
However, as it happens, we do plan to visit on the weekend of April 29. I will make every effort to speak
with Mr. Fesmire. I do not want to pose a barrier to Mr. Fesmire's plans, so as soon as I feel comfortable
with his explanation of the planned project, I will forward to you a signed waiver form.

Dear Mr. Jones:
Thank you for your definitive letter and sketch, re: Jerry Fesmire's request for a boatlift construction
permit. After being able to see more clearly just what he had in mind, I am in agreement with the award of
the permit (although, since the structure will not be within 15 feet of the property line, my approval is a
moot point).
It was never my intent to prevent Fesmire's project from proceeding. All I wanted was more information
about his plans. However, he was never responsive to my call or to my correspondence to him.
