Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythat this project is consistent with the North Carolina Coastal Management Program.

FYI. The letter below grants the Town's permission to you and I to construct a bulkhead across the
easement. We will need to install a set of steps from the top of the wall to the shoreline just in case the
easement is ever opened up in the future. There are no immediate plans or requests to open it up, but I
need to treat this situation like 1 would any other, and I would definitely require others to make sure the
bulkhead did not prevent people from getting to the water.
Please call me if you have any questions or concerns. I imagine that we'll split the cost 50/50 on the wall
and steps - 12.5 feet for you, and 12.5 feet for us.

To whorrrit may concern:
The property owners adjacent to the Town of Emerald Isle's 25' public access easement located on Sound Drive
between 7414 Sound Drive and 7502 Sound Drive are hereby granted permission to construct a 5' bulkhead, at
the property owners' expense, along the entire length of Bogue Sound shoreline across this easement.
Although this public access easement is not currently open to the public, there exists the possibility that such
easement may be opened in the future. For this reason, the Town requires that the adjacent property owners
also construct a set of wooden steps from the edge of the bulkhead to the shoreline to allow the public to reach
the water if / when the public access easement is opened in the future.
