In 1974, the North Carolina General Assembly passed the Coastal Area
Management Act and set the stage for guiding development in fragile
and productive areas that border the state's sounds and oceanfront. Along
with requiring special care by those who build and develop, the General
Assembly directed the Coastal Resources Commission (CRC) to imple-
ment clear regulations that minimize the burden on the applicant.
This application for a minor development permit under CAMA is part
of the Commission's effort to meet the spirit and intent of the General
Assembly. It has been designed to be straightforward and require no
more time or effort necessary from the applicant. Please go over this
folder with the Local Permit Officer (LPO) for the locality in which you
plan to build to be certain that you understand whatinformation he or
she needs.
Under CAMA regulations, the minor permit is to be issued within 25
days once a complete application is in hand. Often less time is needed if
the project is simple. The process generally takes about 18 days. You
can speed the approval process by making certain that your application
is complete and signed, that your drawing meets the specifications given
inside and that your application fee is attached.
Other permits are sometimes required for development in the coastal
area. While these are not CAMA-related, we urge you to check with the
Local Permit Officer to determine which of these you may need. A
listing is included on page 2 of this folder.

the resources of our beautiful and productive coast.

This correspondence is in reference to your June 14, 2006 letter of objection to the pier proposal
of Mr. Thomas Giblin, adjacent to and within Broad Creek, located at 3244 Highway 24,
Newport, Carteret County, NC. The applicant's proposal was for a 211' pier, extending
approximately 152' from the normal high water contour, and approximately 95' into the
waterbody from the edge of the marsh. Because Broad Creek is Primary Nursery Area at this
location, the applicant was encouraged to construct to the minimum —2' nlw contour line to
prevent bottom disturbance from normal use. The final proposal terminates at —2.77' nlw.
Your concerns regarding the proposal appear to relate to the research that the UNC Institute of
Marine Sciences has conducted within this creek for 30+ years, and the consequent discovery of
46 ± fungal species new to science and possibly existing only within the western prong of Broad
Creek for the entirety of the State of North Carolina. Common law within the State of North
Carolina provides for riparian access to owners of waterfront property. The request made by Mr.
Giblin is for a minimal structure, providing no permanent docking, and imposing negligibly on
the creek itself. As a result, the DCM reviewed the application along with your objections and
the pertinent rules of the Coastal Resources Commission and determined that the project is
consistent with the Commission's rules. Therefore, the DCM issued CAMA General Permit
#46070-C to Mr. Thomas Giblin on July 07, 2006, authorizing the pier as proposed by his agent,
Stroud Engineering, on plats received July 07, 2006, indicating the relocation of the proposed
pier to prevent interference with the narrow branch intersecting Broad Creek.
If you wish to appeal this permit decision, you must file a Third Party Hearing Request with the
Director of the Division of Coastal Management, Mr. Charles S. Jones, Department of
Environment and Natural Resources within 20 days of the permit decision. A copy must also be
sent to the Attorney General's Office, Environmental Division. If you wish to appeal, please
