violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythat this project is consistent with the North Carolina Coastal Management Program.

Dear Mr., Hardeman,
The City of New Bern is making plans to install new underwater conduit/cable
lines at (4) locations. The new underwater power line, once installed, will take the
place of the existing overhead, wood pole supported power lines. Once the new
lines are operational, the existing overhead lines will be removed.
Please accept this as the City's Application for CAMA permit for this work.
The following are Bores requiring a CAMA Permit.
1. Bore No. 1— Jack Smith Creek — Permit required.
2. Bore No. 2 — Wilson Creek — Permit required.
3. Bore No. 3 — Brices Creek — Permit required.
4. Bore No. 4 — Tryon Palace — Permit Not required.
5. Bore No. 5 — Old Town — Permit Not required.
6. Bore No. 6 — Scotts Creek — Permit required.
Reference the attached information relative to this application.
Consent letters have been received from all parties except one. This being Wilson
Creek "Country Club Heights Land Owners". Mail to the general delivery address
. was returned unopened. Included in the submittal package is a note from Mr. Joe

• Riddick, P.E. stating that he could not find anyone that knew about this
organization or how to contact them.
It is our understanding that the combination of all (4) bores will be included as
one application. Accordingly a Bank of America's Cashiers Check in the amount
of $100.00 is included.

17, 2004, we had included the drawing for the D.O.T. Encroachment drawings and partial construction observation
for Bore No.1, Jack Smith Creek; Bore No. 2, Wilson Creek and Bore No. 3, Brices Creek. We did not include
preparing the D.O.T. Encroachment Agreement; however, we will be glad to prepare the encroachment agreements
if you want us to prepare them.
Per your request for proposal we are providing you with a fee for each location.

As for the Country Club Heights Land Owners Association, the only information that is available from the
county tax office is listed as general delivery with no reference name. We contacted several of the land owners and
they were not aware that a Land Owners Association was in existence. My feeling would be to send the notification
with request for receipt and put it in the file.
Lewis, we are not familiar with where you intend the Tryon Palace bores to be made, but feel like they
cannot be that difficult to survey.
We thank you for this opportunity to be of service to you and the City of New Bern and are proceeding with
the encroachment agreements for sites 2, 3, and 4.
