This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythatthis project is consistentwith the North Carolina Coastal Management Program.

Reference is made to the undated letter of notice from Broad Creek Construction, Merritt,
NC. The referenced letter has been sent to inform me that Christopher Kuziw is planning
to construct a dock at Fork Point on Ship's Creek in Pamlico County, NC.
On January 18, 2005, Broad Creek Construction, Inc. sent a letter informing my wife and
me of the intent for Christopher Kuziw to build a dock into Ship's Creek. The hand
drawn sketch was incomplete and we were not able to identify necessary information in
order to make as decision upon his request to concur. I called him numerous times to
discuss what was missing. I explained that if he provided the necessary data, we could
then make a decision to concur or not. This did not happen.
On March 2, 2005, I sent a letter (Return Receipt Requested) to Broad Creek
Construction, as a follow up, with our concerns. On April 30, we received another form
letter from Broad Creek Contraction with a hand drawn proposal. Again, from the
drawing we are not able to concur. The drawing is "off scale", appears to be in conflict
with the formal survey obtained when we purchased our property, there is no lot and
block noted, and the proposed creek measurements are disproportionate to the true size of
the creek. Furthermore, it is our belief that the proposed submittal to your organization
requires more detail on the drawing.
As a result of the aforementioned, we are not able to agree to allow Broad Creek
Construction to build a pier as stipulated on the drawing until all pertinent data is
provided IAW CAMA requirements. We also intend to place a dock on our property.
Our concern is that the proposed dock as identified will obstruct the ability of placing a
dock at our property. Until the proper information is provided IAW our request and
CAMA requirements, we are formally objecting to the building of the proposed dock.

On January 18, 2005, your firm sent my wife and I a letter informing us that you had
been hired by Chris Kuziw to build a dock at his Fork Point property. You also enclosed
a form with a sketch of a proposed dock and requested that we sign the form agreeing
that we are familiar with the proposed dock to be built.
I have spoken with you on the phone two times, with the most recent being on February
23, 2004. Both times that we have spoken, I have asked you for the information that is
missing on the sketch and form so that I can make a decision. The information that I
have asked for is the Lot and Block No. to the proposed parcel of property. This was
missing from your document. Also missing from the document is an acceptable drawing
of the property boundaries of Chris Kuziw's property. To date, we have not received
either.
As we have a vested interest in the navigability of the water way and ability to build a
dock for our property without obstruction based on another dock near our property, we
cannot agree to sign the document until we receive the proper documentation that will
clearly and accurately show the description of the proposed development and
construction of the dock per CAMA requirements.
