Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

the Lessor, party of the first part; and KENNELS BEACH IMPROVEMENT
ASSOCIATION, INC. hereinafter referred to as the Lessee, party of the second part;
WITNRSSE'TH:
WHEREAS, Kennels Beach, Inc. has agreed to lease to Kennels Beach
Improvement Association, Inc. land situated along the Neuse River in Pamlico County and
being more particularly described as follows:
BEGINNING at an iron stake located on the southeastern side of the Barnes lot And
the southwest edge of Pecan Lane, a common corner of Barnes Lot and Pecan Lane; and
thence, running S. 45-57-00 W. 51.02 feet to an iron stake located in. the southwest corner of
Live Oak Lane, a common corner with the area commonly known as the Sunday School
Grounds of Kennels Beach; and thence running along Live Oak Lane, S. 48A9-12 E. 457.00
feet to an iron stake located in the Northwest corner of the Disney Lot; and thence running
concurrently with the Disney Lot Line, S. 50-21-06 W. 35.08 feet to an iron stake located at
another corner of the Disney Lot; and thence running along the Neuse River Boundary, N.
26-24-42 W. 57.12 feet to an iron stake; and thence continuing along the Neuse River, N.
43-02-39 W. 49.84 feet to an iron stake; and thence continuing along the Neuse River, N.
49-33-14 W. 126.86 feet to an iron stake located at the Southeastern corner of an existing
boat ramp; and thence proceeding across the said boat ramp, N. 57-46-53 W. 34.77 feet to
an iron stake; and thence continuing along the edge of the Neuse River, N. 56-53-34 W.
126.18 feet to an iron stake; and thence continuing along the edge of the Neuse River, N. 43-
04-34 W. 31.03 feet to an iron stake; and thence continuing along the Neuse River, N. 30-
20-22 W.92.32 feet to an iron stake; this being the southern boundary of the area known as
the Sunday School Grounds of Kennels Beach; and thence continuing from the iron stake,
N. 4042-53 E. 54.24 feet to an iron stake, said iron stake being located at a point in the line
of the Barnes Lot, and being the most western boundary of the area known as the Sunday
School Grounds of Kennels Beach; and thence running along the tine currently with the
Barnes Lot, S. 46-55-31 E. 95.61 feet to an iron stake, the original point of beginning
located on Pecan Lane and the southeastern corner of Barnes Lot.

TERM: The Lessor floes lease to the Lessee the aforedescribed parcel of land
for a term of fifty (50) years beginning July 4, 1998, subject to the hereinafter stated
provisions and conditions.
RENT: The Lessee shall pay to the Lessor the sum of One Dollar ($1.00) per
year as consideration for this Lease.
RESTRICTIONS:
(a) Th-- Lessee agrees that it shall feet sublet any portion of the parcel of
land without first obtaining the written permission of the Lessor.
(b) That no commercial enterprises shall be permitted except as those
conducted. by the Lessee for the use and benefit of the Kennels Beach improvement
Association Fund Raising Event which shall be of temporary duration.
(e) All boat ramps and beach areas located along the boundary of this
aforedescribed lease property shall remain open to the general public for their use and
benefit.
(d) The Lessor reserves the right to construct a pier which shall be for its
personal use only and at a place that shall not interfere with the general public's use of the
boat ramp and beach areas situated along this property.
(e) That upon the Lessee ceasing to exist for a period of three (3) years,
the property herein described shall revert to the Lessor.
(f) The Lessee does herein agree to indemnify and hold harmless the

Lessor from any responsibility associated with the use of this area during the term of this
lease.
