The Division of Coastal Management has reviewed correspondence from you dated 3
January 2005 objecting to the above referenced project. The work consists of building 90' of
bulkhead with 4' walkway; 160' by 5' pier with 16by 16' platform; 17by 17' boat lift with 4' by
26' walkway; jet ski lift on the bulkhead. This project is consistent with North Carolina
Administrative Code 07H.2400 (See Attached), and as proposed is consistent with the
appropriate rules and regulations of this Division. Therefore, on 10 January 2005, Steven J.
Trowell, a member of my staff, issued CAMA/Dredge and Fill General Permit No. 40604 in
Beaufort County, authorizing the aforementioned project, (see attached copy of permit).
If you wish to appeal this permit decision, you must file a request with Mr. Charles Jones,
Director of the Division of Coastal Management, Department of Environment and Natural
Resources at 151-B Hwy. 24, Hestron Plaza II, Morehead City, NC, 27699-1638, within 20 days
of the permit decision. (Appropriate forms are available at the Washington Regional Office).

Objections to the proposed development are based upon the guidelines shown to me by
Steve Trowel cited below:
15A NCAC 07H .0208 USE STANDARDS
(b) Specific Use Standards
(6) Docks and Piers
(D) The apparent combined area of the pier (not including the proposed
wingwall of 456 square feet) is 856 square feet. The shoreline of the lot is 90 feet.
(J) (i) The pier at the condominiums is not "similar" due to the multiple
owners, greater shoreline distance and more "commercial nature", so as not to be
"obtrusive". The pier on Lot #8 is not "similar" because much of the pier distance
extends along the side of the owner's lot (significantly different geography/topography)
where the land is "marshy" (the owner has no other way to access the deeper water). In
addition, lot #7 is "unbuildable" so that the length of the pier is not "obtrusive." The
objection is that the proposed pier is almost 3 times the length of the neighboring pier
and will interfere with both the view from the adjoining lot(s) and
(ii) will extend into the "channel" toward Upper Dowry Creek (see also
section (L))
(7) Bulkheads and Stabilization Measures
(D) (iii) The proposed "vertical seawall" will cause erosion to Lot #5,
particularly at the "natural area" where Lot#5 projects into the river at the edge adjoining
Lot #4 (a natural area that has seen increased growth of vegetation and retention of
sand/soil) at the point where the "vertical seawall" adjoins Lot #5
(E) The proposed "vertical seawall" is a violation of this section. (I have no
objection to the use of rip -rap where Lot 4 and Lot 5 adjoin.)
(9) Wooden and Riprap Groins
Though there is no specific mention of the protection of adjoining property
in this section, it is implied throughout the document (for example in 15A NCAC 07H
.0209 COASTAL SHORELINES, sections c, d and {1).) The proposed groin (jettie) will
cause damage to the adjoining properties by intercepting and retaining the naturally
migrating sand/soil that would be deposited on the adjoining lots in violation of the spirit
and intent of (c) and (d) and possibly causing erosion on those lots.

Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify thatthis project is consistent with the North Carolina Coastal Management Program.
