Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

As we discussed earlier today, my firm has been retained by Everett and Vickie Jenkins
and Collette Burrus to represent them regarding the above referenced CAMA application.
It is my understanding that the Application has been returned to Mr. Fulcher because it
was incomplete. With that being the case, we would like to register our objection to the
issuance of any CAMA permit to Mr. Fulcher for a rip- rap groin in this location;
however, in light of the fact that the Application has been returned to Mr. Fulcher and it
is, as of yet, unknown what the new application will contain, we would request that any
subsequent submittal be provided to my clients for review and comment.
With that said, the main objections that my clients have in regards to the installation of a
rock groin are based on (1) the deterious effect that the rock groin will have on the area
in question, including marsh along the soundfront, (2) the erosion risk posed to the
Burrus property, (3) the lack of any attempt to maintain the creek by routine maintenance
dredging and (4) the excessive iength proposed.
As we discussed, Mr. Fulcher is the owner of property up the creek on which he operates
an RN Park and that his primary interest for the installation of the groin is commercial in
nature and not as a safe harbor. I understand that the boat ramp which he has permitted
was done for single family purposes but it is quite clearly being used as an accessory use
to his R/V park.
In regards to the erosion issue, it is well noted that while rock groins do stabilize
shorelines, there is an increased risk of erosion to properties behind the groin in that they
are no longer being replenished with sand. This will be the case with Mrs. Burrus.
Currently, Mrs. Burrus does not have an eroding shoreline; however, with the
construction of the groin, she will have erosion issues along her shoreline.
My clients believe that prior to the installation of a rock groin, alternative methods should
be employed which will have less of an impact to their respective properties. The creek
has never been the subject of any dredging plan and has not been maintained by Mr.
Fulcher. This is besides the fact that his RN patrons are the primary users of the creek.
If the creek mouth was dredged and then kept up with routine maintenance dredging such
as is the case in so many of the creeks along Bogue Sound, for instance, Pelletier Creek
and Spooners Creek, Mr. Fulcher would find that the creek would be accessible year
round. This would have a minimal impact, if any, on my clients and adjoining property
owners. It is my understanding that the shoreline along the creek is bulkheaded;
however, the sound frontage is not.
Thank you for your time and consideration in this matter and again I ask that we be
provided with a copy of any subsequent application submitted by Mr. Fulcher relating to
this property and allowed to comment.
