may cause the permit to become null and void.
This permit must be on the project site and accessible to the permit of-
ficer when the project is inspected for compliance. The applicant certi-

land use plan and all local ordinances, and 2) a written statement has

RE: Objections to a Permit to Maintenance Dredge the Entrance to Avery Pond
Dear Mr. Beacham:
This letter is in reference to your response, dated February 16, 2001, objecting as an adjacent
riparian property owner to a request by Kitty Hawk Landing Association to maintenance dredge 295'
of canal in Avery Pond, Kitty Hawk, Dare County. Lynn Mathis of the Division of Coastal
Management staff was recently on site and reviewed Kitty Hawk Landing's proposal and found it
consistent with T15A, Section 07H .1500 General Permit for Excavation within or Connecting to
Existing Canals: Basins: or Ditches in Estuarine Waters: Public Trust Waters: and Estuarine Shoreline
AECS, of the North Carolina Administrative Code
The Division of Coastal Management has given careful consideration to your objection and
has determined that the project is consistent with the appropriate rules and regulations, and that all
prerequisite requirements have been met. The Division issued General Permit #28461A on June 26,
2001, to Kitty Hawk Landing Association. If you wish to appeal this decision, you may file a request
with the Director of the Division of Coastal Management, Department of Environment and Natural
Resources within twenty (20) days of the permit decision (See Enclosed Third Party Hearing Form).
