This permit is subject to compliance with this application, site drawing /l~ and attached general and specific conditions. Any violation of these terms may subject the permittee to a fine, imprisonment or civil action; and may cause the permit to become null and void. This permit must be on the project site and accessible to the permit of- ficer when the project is inspected for compliance. The applicant certi- fies by signing this permit that 1) this project is consistent with the local land use plan and all local ordinances, and 2) a written statement has been obtained from adjacent riparian landowners certifying that they have no objections to the proposed work. I have obtained Waterway Photography from the US Army Corps of Engineers which includes the area in which your property is located. It appears that the AIWW does not turn exactly where it was believed that it did. However, it appears that the piers located the most adjacent to the pier under construction are only built out to the right- of-way and not to the 80' setback. I have discussed the situation with our assistant director, Charles Jones, and we are both of the opinion that, in this particular case, no impacts to navigation would result if the pier were to be extended out to the point that the low water depth is the same as the low water depth at the 80' setback. In discussing this with Mr. Varnam he indicated that in his opinion an additional 32' from where the pier now stops would provide this depth. This letter authorizes the extension of the pier permitted by General Permit # 27314D for e distance of up to 32' in a waterward direction from the initial terminus set by the nearby piers.
