This permit is subject to compliance with this application, site drawing
and attached general and specific conditions. Any violation of these terms
may subject the permittee to a fine, imprisonment or civil action; and
may cause the permit to become null and void.
This permit must be on the project site and accessible to the permit of-
ficer when the project is inspected for compliance. The applicant certi-
fies by signing this permit that 1) this project is consistent with the local
land use plan and all local ordinances, and 2) a written statement has
been obtained from adjacent riparian landowners certifying that they
have no objections to the proposed work.
In issuing this permit the State of North Carolina certifies that this project
is consistent with the North Carolina Coastal Management Program.

Mr. Wieczerak has asked that I write to you regarding the proposed pier and bulkheading of Lot
50 of the J, W. Pearson Subdivision owned by Bill Gerrans. Mr. Wieczerak is quite concerned
that ifthc bulkheading and dredging is permitted on Lot 50 that the spoil from the dredge and
bulklicading wit l force water onto his lot which will potentially create drainage as well as septic
Lank problems. Both of these lots are relatively low and any change in the elevation of either will
greatly effect the adjoining lot.
It is with a sense of great urgency that any approval that you might give for the bulkheading and
d"dg"ng of Lot 50 that you will keep in mind and consider the adverse effects that it may
,potenially have on 49_

Dear Sir:
I have been advised that you are constructing a pier and bulkhead facility on Lot 50 of the J. W-
Pearson subdivision currently owned by Bill Gerrans. I understand that you have recently driven
onto a portion of Lot 49 to access the waterfront of Lot 50. You are directed, that henceforth,
neither you nor any of your employees, agents, sub -contractors, or anyone working with you are
to go onto the premises of Lot 49. Any encroachment onto Lot 49 will be dealt with as a trespass
and rq.hedies at law will be pursued accordingly.

Mr. Wieczerak,
I still have not received the letter from your lawyer. I have not had the
time to call your lawyer so if you would please have him at least fax me a
copy of the letter to 252-247-3330. I will take your comments and discuss
the project with my superviosr before any decision is made. Once again you
should receive a letter if the permit is issued regarding any type of third
party appeal. This letter will come from my supervisor only if the permit is
issued over your objection. With your suggestions we might be able to find
some common ground between you and your adjacent property owner.
If you have any questions I will be in the office all day on Wednesday.
