may cause the permit to become null and void.

land use plan and all local ordinances, and 2) a written statement has
been obtained from adjacent riparian landowners certifying that they

Dear Mrs. Parish,
I am writing in response to your letter to the NC Division of Coastal Management, dated
October 3, 1999, and our recent telephone conversation regarding the referenced project. My
original letter, dated September 28, 1999, was intended to notify adjacent riparian property
owners of Jumping Run Creek, as required by the NC Division of Coastal Management's
permitting process, of the Neuse River Water and Sewer District's intent to construct a twelve
inch potable water line along the north side of NC Hwy 55 crossing said Jumping Run Creek.
Your questions have been noted and my response is indexed to concur with your letter.
1. Why is my paved driveway not shown of this map, and if waterline runs of my
side of the highway, who will be responsible for restoring the concrete driveway
to its original condition, repair damage to fencing, and possible damage to
shrubs?
The plan sheet has been corrected to show your driveway and I am attaching a copy for
your review. The contractor is required to replace or repair all items damaged by
construction. I am attaching portions of' Supplemental General Conditions' paragraphs
11, 12 and 13 from our standard construction documents for your review.
2. Since pipe has to be field located by the contractor, will this cause other damage
to my pasture land and disrupt the routine of turning the animals out?
Field location of the existing pipeline by the contractor is required to insure that it is not
damaged by construction of the new line and should not cause any additional damage to
the construction area. Be advised, however, that work of this type requires the use of
large construction equipment. Noise from this equipment may upset your animals,
therefore, you may wish to vary their routine to provide some distance between them
and the work zone.
3. All fencing is on my property.

4. How far will crews go on to my property with equipment and who will is
responsible for possible damage?
The contractor is responsible for all damage to private and public property. Work will be
confined to the highway right-of-way as noted above. If location of existing structures
require construction of the new waterline outside of the right-of-way, representatives of
the District will contact you prior to the start of construction regarding the required
encroachment.
5. Who will be assessed expense for Pay Item --- Directional Drill?
This is a construction note to the Contractor. Payment for the work will made by the
District as described per line item in the Bid Form section of the Contract Documents
prepared and executed for the project. There is no assessment of landowners
associated with this work.

The Owner will furnishl all l@QrJMQRflHR4Rtg-of_wy necessary for the carrying out of this
contract and the completion of the work herein contemplated and will use due diligence in
acquiring said land and rights-of-way as speedily as possible. But it is possible that all
lands and rights-of-way may not be obtained as herein contemplated before construction
begins, in which event the Contractor shall begin his work upon such land and rights-of-
way as the Owner may have previously acquired and no claim for damages whatsoever
will be allowed by reason of the delay in obtaining the remaining lands and rights-of-way.
Should the Owner be prevented or enjoined from proceeding with the work, or from
authorizing its prosecution, either before or after the commencement, by reason of any
litigation, or by reason of its inability to procure any lands or rights-of-way for the said work,
the Contractor shall not be entitled to make or assert any claim for damage by reason of
said delay, or to withdraw from the contract except by consent of the Owner, but time for
completion of the work will be extended to such time as the Owner determines will
compensate for the time lost by such delay, such determination to be set forth in writing.
Vol1.1 The Contractor shall confine his construction operations to the immediate vicinity of
(fes the location shown on the plans and in no case shall be encroach beyond the limits
of the Owner's property or right-of-way. He shall place materials, equipment,
supplies, etc., so as to cause the least possible damage to property and
interference with traffic. His method of operation and placing of equipment and
materials shall be subject to the approval of the Engineer.

It shall be the duty of the Contractor to locate the limits of the rights-of-way, or
property lines, prior to beginning construction. He shall be solely responsible for
damage to trees, crops or other property outside the boundaries of the right-of-way
and shall make satisfactory settlement for any damage directly with the property
owner involved.
11.3 Where timber is located on the property or right -of way, the Contractor shall
preserve and protect from damage all trees that do not directly interfere with the
prosecution of the work. The Contractor shall not cut any tree greater in diameter
than six inches and located more than eight feet from the centerline of ditch or
structure without first consulting the Engineer.
(1.-4 Where shrubbery or grass is located on the construction right-of-way the Contractor
shall be fully responsible for any damage thereto. He shall remove, protect and
replant all shrubbery to the full satisfaction of the Engineer and property owner and
shall either remove and resod or replant all lawns or pasture grass damaged by the
construction work. Topsoil shall be replaced and grass of the same type found shall
be planted, fertilized and watered in accordance with good practice, until a
satisfactory stand of grass is secured.
1.5 Excavation, grading, fill, storm drainage, paving and any other construction or
installations in rights -of -ways of streets, highways, public carrier lines, utility lines
(either aerial, surface or subsurface), etc., shall be done in accordance with
requirements of the authorities having jurisdiction and of applicable requirement of
these specifications. Contractor shall make all necessary arrangements with the
proper authorities, including the obtaining of permits, approval of construction
methods, etc., and shall pay all costs charged in connection with the work.

The Contractor shall be responsible for removing and dis o HE ° • s or
obstacles at the site of the work or along the right-of-way therefor, to the satisfaction of the
Engineer. Minor obstructions shall be removed and properly disposed of or protected and
re -erected to as good a condition as found, at the same or adjacent locations, as directed
by the Engineer.
12.1 Fences at the site or along the right-of-way, which interfere with the construction
operations, shall be maintained by the Contractor until completion of the work
unless written permission is obtained from the Owner thereof to leave the fence
dismantled until construction is completed. He shall remove, rebuild and extend
fences as necessary to keep stock away from the construction area or from
straying away.
12.2 Upon completion of work, all fences are to be restored to their original location and
condition, unless shown differently on the Plans. The Contractor shall purchase
new material, if necessary, to replace all materials damage, lost, or destroyed.
SGC 13 - PUBLIC CONVENIENCE AND PROTECTION
During progress of the work, the convenience and protection of the public must be
provided for, and interferences held to a minimum.
13.1 The Contractor shall, at all times, conduct the work in such a manner as to insure
the least practicable obstruction to public travel. The convenience of the general
public and of the residents along and adjacent to the area of the work shall be
provided for in a satisfactory manner, consistent with the operation and local
conditions. Roads and streets must be kept open at all times or suitable detours
provided. When necessary to close streets, "Street Closed" signs shall be placed
immediately adjacent to the work, at such locations as traffic demands and the
Contractor shall notify the Owner, law enforcement agencies, fire departments and
parties operating emergency vehicles before the street is closed and again as soon
as it is opened. Access to fire hydrants and other fire extinguishing equipment shall
be provided and maintained at all times.
13.2 When necessary, the Contractor shall provide watchmen and lights to burn
between twilight and sunrise, and shall erect and maintain barriers and all other
necessary protection about the work at his own expense. He shall also take other
precautions as may be necessary to protect life, limb, and property. The Owner
reserves the right to remedy and neglect on the part of the Contractor as regards to
the protection of the work after twenty-four (24) hours notice in writing; and, in
cases of emergency, the Owner shall have the right to remedy and neglect without
previous notice, and in either case deduct the cost of such remedy from money due
the Contractor.

I am in receipt of correspondence dated 09-28-99 ,received 10-02-99, in reference to installation
of new waterlines along Highway 55 W.(letter attached.)
In review of the aerial map it seems quite evident that the present waterline is opposite the
Mercer and Hawkins property , meaning on the Parish and Dillanhunt side based on the lightly
shaded area indicating HWY 55 and location of bridge across HWY 55 .1 am inclined to think
that I am correct.Therfore I have the following questions:

7. CONTRACTOR SHALL RESET ALL DISTURBED MAILBOXES, SIGNS, ETC.
8. CONTRACTOR SHALL REWORK ALL GRAVEL, CONCRETE AND PAVED DRIVEWAYS ACCORDING
BUS TO THE SPECIFICATIONS.
43 9. THE CONTRACTOR SHALL COORDINATE ALL SERVICE INTERRUPTIONS WITH THE CRAVEN COUNTY
WATER DEPARTMENT. THE COUNTY SHALL BE NOTIFIED A MINIMUM OF 5 WORKING DAYS PRIOR TO
ANY REQUIRED SERVICE INTERRUPTION TO ALLOW TIME FOR NOTIFICATION OF AFFECTED CUSTOMERS.
10. CONTRACTOR TO MINIMIZE PLACEMENT OF EXCAVATION MATERIAL ON ROAD DURING CONSTRUCTION.
CONTRACTOR TO COVER ASPHALT WITH SAND PRIOR TO PLACEMENT OF EXCAVATED MATERIAL ON
PAVEMENT. ALL STREETS SHALL BE CLEANED DAILY.

11. CONTRACTOR TO PLACE ALL SPOIL MATERIAL ON THE UPHILL SIDE AWAY FROM ALL ROAD SIDE
DITCHES, CREEKS AND WATER COURSES DURING CONSTRUCTION.
12. ALL DISTURBED DITCH LINES SHALL BE RESHAPED, RESEEDED, MULCHED AND TACK COAT APPLIED.
13. ALL WATER SERVICE CROSSINGS ON OPPOSITE SIDE OF ROAD SHALL BE DRY BORED EXCEPT
ON GRAVEL OR SOIL ROADS. WATER SERVICES WILL BE SET IN THE FIELD AS DIRECTED
BY THE COUNTY AND THE ENGINEER.
14. INSTALL SILT FENCE PERPENDICULAR TO WATER LINE AT LARGE CULVERTS (+30") UNTIL RIP -RAP
(, IS INSTALLED OR GRASS STABILIZED.
15. ALL VALVES AND REDUCERS SHALL BE SUPPORTED AND RODDED TO ADJACENT FITTINGS OR
PROVIDE THRUST COLLAR FOR RODDING.
