Smith, Jr. 114 Dogwood Drive Williamsburg, Virginia 23185 FAX #: (804) 253-9281 Dear Mr. Smith: -iz79y IDEHNf� October 13, 1993 `993 �•+.sw....... + ... -- On October 12, 1993, I inspected your property located at 4237 Virginia Dare Trail, Kitty Hawk, Dare County adjacent the Atlantic Ocean. The purpose of my inspection was to investigate your property so as to address your request for a LAMA permit to authorize the placement of a sandbag erosion control structure on your property. My inspection revealed that the existing residential structure is located a minimum of 63 feet landward of the erosion escarpment or first line of stable natural vegetation. The mean high water line was found to be approximately 15 feet east of the aforementioned erosion escarpment. From my discussion with your wife on 10/11/93, it is my understanding that a septic tank and drainfield exist between the existing structure and the erosion escarpment. No above -ground evidence of this system was found. To be eligible for a LAMA general permit for the construction of a temporary sandbag erosion control structure, your residential structure must be considered to be an imminently threatened structure. Pursuant to North Carolina Administrative Code T15A: 07H.1705(a)(2), the foundation of your structure must be within 20 feet of the erosion scarp. The septic system your wife referred to is not considered in determining whether or not your structure is imminently threatened. Since the foundation of your residential structure is located 63 feet from the erosion scarp on your property, your request for a CAMA permit for a temporary sandbag structure is hereby denied. For your information, I have enclosed a copy of the regulations (NCAC T15A: 07H.1700) pertaining to temporary sandbag erosion control structures. You may choose to seek a variance which would allow you to construct a temporary sandbag erosion control structure. Our governing board, the Coastal Resources Commission hears and decides upon all variance requests. I am enclosing the forms that you will need to fill out should you desire to seek a variance.
