Any violation of these terms may subject the permittee to a fine, imprisonment or civil action; and may cause the permit to be- come null and void. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Schecter, Director 29 August 1994 Mrs. Elsa Desrochers Black Beard's view Route 1, Box 14AB Bath, North Carolina 27808 Dear Mrs. Desrochers: �EHNR nrpm Aus 3 1 1994 This correspondence is in reference to your 6 August 1994 letter objecting to the proposed pier and boat slip construction onsite Mr. Buck Sitterson's property in the Kirby Grange Development off of Highway 92, on Slade Gut, off Back Creek, near Bath, in Beaufort County, North Carolina. I have reviewed your objection to the proposed pier and boat slip, discussed the project with Mr. David Gossett, Field Representative for the Division of Coastal Management, and conclude that the proposed construction is consistent with those guidelines for development found in Subchapter 0.7H of the North Carolina Administrative Code. Therefore, I recommended a permit be issued for the construction (see attached). However, with regard to concerns expressed by you during our 18 August 1994 onsite meeting, I offer the following considerations: (1) Mr. Sitterson's pier is conditioned not to exceed a height of 10 inches above his existing bulkhead; (2) the pier has been shortened from 40' waterward of the existing marsh to 35' waterward of the existing marsh; and (3) he (Mr. Sitterson) must contact the Division of Coastal Management prior to undertaking any additions or modifications to the permitted structure. If you wish to challenge my granting of the permit, you may file a third party hearing request with the Chairman of the Coastal Resources Commission as provided in G.S. 113A-121.1(b) within 20 days of the permit decision. I understand your concerns and tried to incorporate them into the permit decision but as I explained onsite, the proposed construction is consistent with our guidelines for construction. Thank you for your time and cooperation with the permit process. Copies of the Third Party Hearing Request form are included should you want to appeal my decision.
