Cheek, of Carteret County, North Carolina, party of the first part, hereinafter called "Seller", and George IW. Page, of Carteret County, North Carolina, party of the second part, hereinafter called "Buyer"; W I T N E S S E T H WHEREAS, Buyer agrees to sell to Seller and Seller agrees to buy from Seller, the following described tracts or parcels and land: Lying and being in the Town of Beaufort, Carteret County, North Carolina, and designated on the map of said town as LQJ 27 Old Town , Beaufort, as described in that deed of record-li—n—B—o-o"k 159, Page 10, Carteret County Registry, amd the water lot directly in front of said Lot 27, designated on said map as Lot 238, Old Town Beaufort, as shown on that deed of record in Book 136, Page 85, Carteret County Registry. THE TERMS AND CONDITIONS of this contract are as follows: 1. The purchase price for said premises is five thousand dollars ($5,000.00) to be paid at the time of the execution of this contract -as earnest money, and the balance to be paid at closing. If contract fails to close for reasons set forth in Paragraph 3 or for title deficiency, the earnest money will be returned to Buyer. 2. Seller shall be entitled to possess, for purposes of maintaining her residence, the residential structure located on Lot 27, Old Town, for a period not to exceed twelve (12) months 1!from the date this contract is closed, rent-free. As an element E lof said possession, Seller shall continue to have the use of the ldriveway, backyard parking area and front lawn. 3. This sale is conditioned that the said dwelling house on said premises is structurally sound, and the Buyer shall, immediately following the execution of this agreement, have the privilege to make such inspection of the structural members of said dwelling house as he may see fit and use as an element thereof such persons as he may see fit. If Buyer shall determine, within his own discretion, that the structural members of said dwelling house are not sound or adequate, then he shall be privileged to request that Seller, at Seller's expense, repair said structural members, and in the event Seller refuses to make such repairs, Buyer shall be privileged to terminate this agreement. It is specifically provided that said inspection shall be completed within twenty-five (25) days of the execution of this contract, and that notice of deficiencies shall be immediately thereafter furnished to Seller, and in the event Seller elects to effect repairs, the repairs will be completed within thirty (30) days thereafter. The closing of this contract shall occur no later than sixty (60) days from the date of execution. In the event Buyer shall not object to the structural members of the said dwelling, this agreement will be closed no later than thirty (30) days from the date of execution. 4. This sale is also conditioned upon Buyer being able to obtain a permit from CAMA for the construction of a dock for the use of his recreational boats on the riparian area of the water lot. Buyer has been advised that this permit receipt may require 3 las much as ninety (90) days for issuance. In the event Buyer is advised that the permit is available to him, this agreement will be closed within a reasonable time thereafter. If Buyer is refused the permit for the dock constrution, then Buyer may, at his option, terminate this agreement. 5. During the one-year occupancy by Seller as hereinabove set forth, Buyer shall be privileged to make external repairs or improvements on the building as he may see fit and shall have absolute possession of the water lot 238, Old Town. It is understood and agreed that Buyer will take reasonable precautions not to disturb the possession of Seller while effecting repairs or maintenance, and that both parties will be reasonable in their mutual demands in regard thereto. 6. Ad valorem taxes will be prorated as of date of closing lof this transaction. 7. Seller will prepare a good and sufficient deed conveying) (said premises in fee simple, free and clear of all liens and lencumbrances. 8. Buyer shall be privileged to effect such surveys as he Imay deem proper and to make such examination of the title as he Imay deem proper. 9. Seller agrees that the premises will be conveyed in fee, simple, free and clear of encumbrances, and if objection to the title is made by Buyer predicated upon a reasonable examination by attorneys of Buyer's choosing, Seller shall have thirty (30) days thereafter in which to effect a removal of the title defects if any should appear. r i �I 4 I ] i 10.
