Dear Barney:
I received today my copy of the DOT application to dredge borrow material from
Pamlico Sound to nourish the beach along N.C. Highway 12. This letter is my
immediate response to the proposal to pose some obvious questions that need to
be answered early in the process to avoid delaying a decision. The official
acknowledgement of receipt of the application will come from our Elizabeth
City office according to our normal procedures.
What are the SEPA requirements for this project? This appears to be a project
requiring a major expenditure of funds, it obviously needs a permit and there
is the potential for significant impacts on the environment. Under these
circumstances, a SEPA review would normally be necessary.
You have acknowledged in your transmittal letter that much the 170 acre area
from which the borrow material will be removed is vegetated with SAVs.
Alteration of these areas will be of major concern to many of the review
agencies and I expect that they will insist that areas of existing vegetation
and documented SAV habitat be avoided. Issuing a permit to allow dredging an
unspecified area within the 170 acre site may not be practical. A better
approach would be to coordinate the proposal with the appropriate agencies to
try to identify more specifically the location of the 6.2 acres of dredge area
needed for the project. This will refine the scope of the project and help to
better assess its impacts.
I also suggest that this proposal be added to the agenda for the agency
coordination meeting scheduled for August 19 in Raleigh. Please let me know if
it is and I will try to attend.
