Enclosed are letters from the Aquarium's adjacent property owners
granting "no objection" to the proposed dock on Bogue Sound.
Also, I've enclosed the letter from Ed Beck of DEM that explains
that no NPDES permit will be required.
I hope to know soon above the timing of the bid process for the
dock. Also, I should be able to secure the budget transfer ($50)
very soon. I will keep you informed.

Subject: Discharge of Water from Aquariums

Dear Mr. Barnes:
Your letter which describes the discharge of water from
aquariums at the Pine Knoll Shores facility has been reviewed. It
is understood that water is discharged to Bogue Sound and to a
subsurface drain due to water changes in salt water tanks and
filter backwashing in the fresh water tanks. The approximate
discharge rate is 3,000 gallons per month of saltwater and 1,500
gallons per month of freshwater. It is understood that the quantity
of fish held at the facility is far below the production rate of
100,000 pounds per year specified in the Federal Guidelines for
concentrated aquatic animal production facilities.
Based on my review of your proposal, it appears that the
facility does not constitute a concentrated aquatic animal
production facility. It also does not appear that the existing
discharge is causing an adverse impact on water quality in the
receiving waters. An NPDES Permit will, therefore, not be required.
Your submittal will be kept on file. If you have any questions
or require additional information, please call me at (919) 395-

Thank you for your recent letter and your efforts to
coordinate the CAMA General Permit process with the folks at the
Aquarium in Pine Knoll Shores. As you know, I have been working
closely with Jay Barnes to put together a pier project that not
only meets their needs but one that is consistent with our
regulations.
As of this time, I have received all the necessary paperwork
pursuant to 15 NCAC Subchapter 7H.1100. A copy of that regulation
is enclosed for your review. Although I an ready to issue GPC-
#12050, I will wait to hear from you or Jay as to actual date of
issuance so that the 90 day time clock can be coordinated with the
contractor and his on -site schedule.

The dock pump shed needs to be constructed with a pressure treated 2x4 wood frame w/ studs on 16"
centers and sheathed with pressure treated 1/2", t-111 plywood w/ grooves on 8" centers. It will have a
shed roof w/ a 15 degree pitch and be comprised of p.t., 2x4 wood rafters on 16" centers. Each main
rafter that spans the front and back wall will have 2 seat cuts and 2 plumb cuts to fit the front and back
walls as shown in the section view. Sistered to the main rafters are smaller rafter sections notched to the
front wall top plate to create an overhang in the front of the shed and maintain an overall height of 3'-0"
from deck to roof peak. Each rafter will be toe nailed and have at least 1 hurricane tie at every connection
to a wall. The roof frame will be covered with 1 /2" p.t. plywood over which is 30# felt paper with 15 year
durability asphalt shingles. The pump shed will house 2 pumps initially with more planned in the future.
