Mi. +� �u� 2 s Mesa The Board of Adjustment for the Town of Cape Carteret held a public hearing on July 18, 1994 to consider application #94-2 submitted by Mr. James Lamb, a request to erect a resi- dence at 312 Bogue Sound Drive with a front yard of less than the 40 ft. required by the Ordinance, under Chapter 155.052 and appendix A to Chapter 155. The Board having heard all the evidence presented at the hearing makes the following Findings of Fact and draws the following Conclusions: The Board found that the hardship of which the applicant complains results from unique circumstances relating to the lot. Because of the condition of the soil the Carteret County Health Department will permit a sewage disposal system at only one specific location on the lot. Because it is a waterfront lot, CAMA regulations pertaining to construction apply. The combination of Health Department and CAMA rules severely reduced space on the lot for erecting a residence. The Board also found that the request was in Harmony with the general purpose and intent of the Ordinance. The pro- posed residence was of modest size having been reduced be- cause of the problem and the encroachment was minimal and dictated by the circumstances. The reduction in the view of the water from other homesites in the neighborhood would not be significant because at present the lot is heavily wooded and must remain so under CAMA rules. Therefore, the Board Concluded that if the variance is not granted the applicant cannot make reasonable use of his prop- erty. It also concluded that granting the variance would not affect the public safety and welfare and that if it was granted justice would result. Therefore, it is ORDERED that the application for a variance be GRANTED and the applicant be authorized to erect a house with the front yard setback dimensions as shown on the Pre- liminary Plot Plan, sheet 1 of 2 appended to the application. The approval process for the I :PP system design, Health Department site modification, and CAMA residential exemption can now proceed. In z addition, the surveyor's map and report, the zoning variance application, and a copy of the health department modification approval letter arc enclosed. The variance hearing is presently scheduled for the 18th. If additional information is needed to determine if the project qualifies for the exemption, please let me know and I forward =' it to you as soon as I can. I will advise you of the results and provide you with documentation if approved. Per our recent phone discussion, I've also enclosed a blank copy of the CAMA application I have in my word processing software. Under CAMA regulations the minor permit is to be issued within 30 days once a complete application is in hand. Often less time is needed if the project is simple.
