This permit, issued on SEPTEMBER 30, 1994 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void. Travel Lift Installation 1) The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U. S. Coast Guard, through regulations or otherwise, on authorized facilities. 2) The project will be done in such a manner so as to not cause turbidity outside the immediate construction area to exceed 25 NTUs. 3) If the permittee discovers any previously unknown historic or archaeological remains while accomplishing the authorized work, he will immediately notify the Division of Coastal Management; and the Wilmington District Engineer who will initiate the required State/Federal coordination. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1997 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. NOTE: Permanent reflectors should be attached to the structure in order to make it more visible during hours of darkness or inclement weather. Operation and Maintenance 5) No sewage, whether treated or untreated, shall be discharged at any time from boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 6) This permit authorizes only the structure and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structures, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures may be conducted on, in, or over public trust waters without permit modification. 7) The authorized structure and associated activity must not cause an unacceptable interference with navigation. 8) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. 9) The permittee will maintain the authorized work in good condition and in conformance with terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having the permit transferred to a third party. NOTE: The permittee is advised to exercise all available precautions in the operation of the facility to prevent sand blasting residue and/or other facility waste from entering the adjacent waters. Such discharge, either directly or indirectly to adjacent waters, could contravene State water quality standards, thereby violating State law. Island Marina), Carteret County DATE: September 21, 1994 Island Marina is located at 180 Radio Island Road, on the Newport River, near the Town of Beaufort, Carteret County. Mr. Brown proposes to construct a travel lift at the site. AECs impacted by the proposal include Estuarine Waters and Public Trust Areas. Waters at the site are classified as 'SA' and are closed to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the 1991 Carteret County Land Use Plan (LUP) Update, as amended September 24, 1993, and offer the following comments. The general area of the project is classified as Developed, while the AECs impacted by the proposal are classified as Conservation. Applicable policies contained in the LUP include those for Marine Resource Areas (Page IV -11). The LUP states the County's support for the 7H Use Standards for estuarine and public trust waters, with a few exceptions, none of which appear to be applicable to this project. NARRATIVE DESCRIPTION: The applicant's property is located on an approximately .75 acre tract of land adjacent to a tidal basin off the Newport River at 180 Radio Island Road between the towns of Morehead City and Beaufort in Carteret County. There are several small marinas in this same basin. Presently on the site are 10 boat slips plus a travel lift slip, several buildings being used as storage, work or tool shops. The owner has purchased a new travel lift which is larger than the existing one. He proposes to eliminate two of the boat slips and install a new travel lift in this area. The new travel lift slip would consist of 2 runways measuring approximately 46' long x 3' wide each running out perpendicular to the existing bulkhead. The runway to the west side would be constructed adjacent to the existing travel lift runway making this side 7' wide. Waters at the site are classified as 'SA' by the Division of Environmental Management and are closed to shellfishing. 10. ANTICIPATED IMPACTS: Presently on the applicant's property are 10 boat slips and one travel lift slip. The applicant proposes to remove two of these slips and install another travel lift. The new travel lift will consist of 2 runways measuring approximately 46' long x 3' wide each, with 18' separation between the runways. This would result in approximately 1150 sq. ft. of public trust area being shaded by the installation and operation of the travel lift. This would result in a net decrease of 2 boat slips with 8 slips being available at the site.
