This permit, issued on SEPTEMBER 30, 1994 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be
subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
Travel Lift Installation
1) The permittee must install and maintain, at his expense, any signal lights and signals prescribed
by the U. S. Coast Guard, through regulations or otherwise, on authorized facilities.
2) The project will be done in such a manner so as to not cause turbidity outside the immediate
construction area to exceed 25 NTUs.
3) If the permittee discovers any previously unknown historic or archaeological remains while
accomplishing the authorized work, he will immediately notify the Division of Coastal
Management; and the Wilmington District Engineer who will initiate the required State/Federal
coordination.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31, 1997
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

ADDITIONAL CONDITIONS
4) No excavated or fill materials will be placed at any time in any vegetated wetlands or waters.
NOTE: Permanent reflectors should be attached to the structure in order to make it more visible
during hours of darkness or inclement weather.
Operation and Maintenance
5) No sewage, whether treated or untreated, shall be discharged at any time from boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation
of this permit for which the permittee is responsible. This prohibition shall be applied and
enforced throughout the entire existence of the permitted structure.
6) This permit authorizes only the structure and uses located in or over the water that are expressly
and specifically set forth in the permit application. No other structures, whether floating or
stationary, may become a permanent part of this docking facility without permit modification.
No non -water dependent uses of structures may be conducted on, in, or over public trust waters
without permit modification.
7) The authorized structure and associated activity must not cause an unacceptable interference with
navigation.
8) No attempt will be made by the permittee to prevent the full and free use by the public of all
navigable waters at or adjacent to the authorized work. Use of the permitted activity must not
interfere with the public's right to free navigation on all navigable waters of the United States.
9) The permittee will maintain the authorized work in good condition and in conformance with
terms and conditions of this permit. The permittee is not relieved of this requirement if he
abandons the permitted activity without having the permit transferred to a third party.
NOTE: The permittee is advised to exercise all available precautions in the operation of the
facility to prevent sand blasting residue and/or other facility waste from entering the
adjacent waters. Such discharge, either directly or indirectly to adjacent waters, could
contravene State water quality standards, thereby violating State law.
NOTE: Future development on the permittee's property may require a modification of this
permit. Contact a representative of this Division at (919) 726-7021 prior to
commencement of any such activity for this determination.

Dear Mr. Parker:
Reference the application of Island Marina, C/O Mr. Ronald
Brown, for a Department of the Army permit to construct a travel
lift adjacent to the Newport River, Carteret County, North
Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
1. All work authorized by this permit must be performed in
strict compliance with the permit plans.
2. No excavated or fill materials will be placed at any time
in any vegetated wetlands or waters.
3. No attempt will be made by the permittee to prevent the
full and free use by the public of all navigable waters at or
adjacent to the authorized work. Use of the permitted activity
must not interfere with the public's right to free navigation on
all navigable waters of the United States.

4. The permittee will maintain the authorized work in good
condition and in conformance with the terms and conditions of
this permit. The permittee is not relieved of this requirement
if he abandons the permitted activity without having it
transferred to a third party.
10. If the permittee discovers any previously unknown

authorized work, he will immediately notify the Wilmington
District Engineer who will initiate the required State/Federal
coordination.

On February 11, 1991, we renewed general permit No. CESAW-CO80-N-000-0291
(copy enclosed), which provides Federal authorization for construction
activities that receive authorization from the State of North Carolina.
A review of your application received August 17, 1994, for Department of
the Army authorization to reconfigure marina facilities to eliminate two boat
slips and construct a second travel lift on a tidal basin off the Newport
River, Radio Island, Carteret County, North Carolina, indicates it to be a
candidate for Federal authorization under this general permit. Accordingly,
the administrative processing of your application will be accomplished by the
North Carolina Division of Coastal Management. Comments from Federal review
agencies will be furnished to the State.
If your application must be withdrawn from this general permit process
for any reason, you will be informed regarding its further management. If
there are no unresolved differences in State -Federal positions or policies,
the final action taken on your application by the State will result in your
receiving written notice from us that your application is consistent with the
general permit and you may commence your activity. Only after receiving such
confirmation should you begin work.
Your application, pursuant to Section 10 of the River and Harbor Act, has

SUBJECT: Consistency Determination, Major Permit Application,
Ronald K. Brown (d.b.a. Island Marina), Carteret County
DATE: September 21, 1994
Island Marina is located at 180 Radio Island Road, on the Newport
River, near the Town of Beaufort, Carteret County. Mr. Brown
proposes to construct a travel lift at the site.
AECs impacted by the proposal include Estuarine Waters and Public
Trust Areas. Waters at the site are classified as 'SA' and are
closed to the harvesting of shellfish. The area is not a Primary
Nursery Area.
I have reviewed this proposal for consistency with the 1991
Carteret County Land Use Plan (LUP) Update, as amended September
24, 1993, and offer the following comments.
The general area of the project is classified as Developed, while
the AECs impacted by the proposal are classified as Conservation.
Applicable policies contained in the LUP include those for Marine
Resource Areas (Page IV -11). The LUP states the County's support
for the 7H Use Standards for estuarine and public trust waters,
with a few exceptions, none of which appear to be applicable to
this project.
Based on the above, this project appears consistent with the
amended 1991 Carteret County Land Use Plan, provided all state
standards can be satisfied.

9. NARRATIVE DESCRIPTION: The applicant's property is located on an
approximately .75 acre tract of land adjacent to a tidal basin off the Newport River at
180 Radio Island Road between the towns of Morehead City and Beaufort in Carteret
County. There are several small marinas in this same basin. Presently on the site are
10 boat slips plus a travel lift slip, several buildings being used as storage, work or
tool shops. The owner has purchased a new travel lift which is larger than the existing
one. He proposes to eliminate two of the boat slips and install a new travel lift in this
area. The new travel lift slip would consist of 2 runways measuring approximately 46'
long x 3' wide each running out perpendicular to the existing bulkhead. The runway
to the west side would be constructed adjacent to the existing travel lift runway making
this side 7' wide. Waters at the site are classified as 'SA' by the Division of
Environmental Management and are closed to shellfishing.
10. ANTICIPATED IMPACTS: Presently on the applicant's property are 10 boat slips
and one travel lift slip. The applicant proposes to remove two of these slips and install
another travel lift. The new travel lift will consist of 2 runways measuring
approximately 46' long x 3' wide each, with 18' separation between the runways.
This would result in approximately 1150 sq. ft. of public trust area being shaded by the
installation and operation of the travel lift. This would result in a net decrease of 2
boat slips with 8 slips being available at the site. The travel lift runways would not
extend out into the basin any further than the existing pilings or existing runways.

Dear Mr. Brown:
The Division of Coastal Management hereby acknowledges receipt of your application
for State approval for development of your property located at 180 Radio Island Road, on the
Newport River, near the Town of Beaufort, Carteret County. It was received on July 21,
1994, and appears to be adequate for processing at this time. The projected deadline for
making a decision is October 5, 1994. An additional 75 -day review period is provided by
law when such time is necessary to complete the review. If you have not been notified of a
final action by the initial deadline stated above, you should consider the review period
extended. Under those circumstances, this letter will serve as your notice of an extended
review. However, an additional letter will be provided on or about the 75th day.
NCGS 113A -119(b) requires that Notice of an application be posted at the location of
the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard
which must be posted at the property of your proposed development. You should post this
notice at a conspicuous point along your property where it can be observed from a public
road. Some examples would be: Nailing the notice card to a telephone pole or tree along the
road right-of-way fronting your property; or at a point along the road right-of-way where a
private road would lead one into your property. Failure to post this notice could result in an
incomplete application.
An onsite inspection will be made, and if additional information is required, you will
be contacted by the appropriate State or Federal agency. PIease contact me if you have any
questions and notify me in writing if you wish to receive a copy of my field report and/or
comments from reviewing agencies.
