Dear Mr. Lane: This letter serves to confirm our phone conversation of last week regarding the merits of the referenced project and your noted objections. As I explained, my review of Mr. Eriksson's request to expand his pier is consistent with the specific use standards as found in 15NCAC Subchapter 7H.1200. Enclosed is a copy of the regulation for your consideration as well as a copy of the actual permit issued to Mr. Eriksson on September 16, 1994. Most important to your concerns and to the proper administration of the general permit is the letter of assurance from Mr. Eriksson that states the pier modifications are for private non-commercial use. Pursuant to Subchapter 7J.0301 and .0302, you may file a request to appeal the permit decision to the Coastal Resources Commission within 20 days from the date of issuance. I have attached a copy of the appropriate regulation for your information. Eriksson Dear Mr. Mercer: This is to inform you of my objections to the permit which Mr. Leif F. Eriksson is seeking to expand his pier in front of his house at 504 Madam Moores Lane, New Bern, North Carolina. I have specific objections to the granting of this permit. In light of Mr. Eriksson's previous activities of repairing boats, both for himself and others, I am greatly concerned that the expansion of his dock is for the purpose of initiating a commercial boat repair business. Any such commercial interest is prohibited under the restrictive covenants of the subdivision. As shown on the attached Deed, it prohibits any building or structure for any purpose which may be offensive to the neighboring inhabitants, and further states that no noxious or offensive trade shall be carried on upon the land. Clearly, a commercial use of a "mini -marina" will substantially affect the adjacent property owners' use and enjoyment of their property as well as directly affect and diminish the property values. In the very recent weeks, Mr. Eriksson has installed heavy commercial wiring and other related utilities to his dock. Mr. Eriksson has an older Chris Craft currently docked at his pier that is approximately 30 feet !on-. In addition thereto, there is a small ski boat. The expansion as designed would allow for possibly 3-4 other boats to be docked and accessed. This tends to indicate a non -pleasure use. Please consider the enclosed deed and restrictive covenants contained therein. Further, as the adjacent land owner, please consider favorably my objections to the increased dock space requested.
