Any violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s) . The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available information and belief, certify that this project is consistent with the North Carolina Coastal Management Program. Ross Jr., Secretary March 25, 2004 Mr. Bill Olander 846 Newbury Court Schaumburg, IL 60173 Re: Objection to the Issuance of CAMA General Permit No. 36574-A Cutty Sark Development and Wallace Beckham, Avon Village, Dare Co. Dear Mr. Olander: This letter is in response to your objection as an adjacent riparian property owner to a permit request from Mr. Gary Sisler, an agent for the Cutty Sark bulkhead project in Avon, Dare County. This project involves the construction of a bulkhead along the shoreline of their property along a man-made canal that connects to the Pamlico Sound. Dennis Hawthorn, of the Division of Coastal Management staff, was recently onsite to evaluate the property owners' request. The property owners have requested a permit to stabilize 500 linear feet of the canal bank at this time. Under the Coastal Area Management Area (CAMA), the Coastal Resources Commission (CRC) has established Rules, referenced in 15A of the North Carolina Administrative Code (NCAC), Subchapter Section 07H .1100, for General Permits for this type of development. An approved bulkhead alignment has been staked landward of all vegetated wetlands. Mr. Hawthorn noted that approximately 200 linear feet of shoreline near the rear of the existing dwelling on -site is vegetated in a narrow fringe of coastal wetlands grasses. The permit for the bulkhead alignment does not allow for any stabilization waterward of this fringe, nor the filling of any vegetated wetlands. The property owners proposed development is consistent with the Rules of the CRC for shoreline stabilization with a bulkhead alignment. In that the total length of shoreline that the owners want to stabilize exceeds the 500 feet limit of the General Permit rules, they plan to request a modification to their existing CAMA Major Permit to authorize an additional 400 plus feet of shoreline stabilization. It is my understanding that you and Mr. Hawthorn spoke on March 24, 2004, concerning your objections, and that this dealt with the filling of a wetland fringe along the far northern corner of the permit applicants' property. As referenced above, the current proposal will not involve the filling of any wetlands. In this regard, Mr. Hawthorn has reviewed all aspects of this current proposal for consistency with 15A NCAC, Section 07H.1100, which describes the standards and guidelines for the construction of the requested bulkhead. Our review of the proposed development has found it to be consistent with NCAC Subchapter Sections 07H .1100. After having given your objections to this proposal careful consideration, we have determined that the proposed project is consistent with the appropriate rules and regulations and that all pre -requisite requirements have been satisfied. In this regard, the Division of Coastal Management issued General Permit # 36574-A for the proposed development on March 19, 2004 (copy attached) for the proposed development. If you wish to appeal this permit decision, you must file a Third Party Hearing Request Form with the Director of the Division of Coastal Management within 20 days of the permit issuance date. If you choose to pursue an appeal, please contact this office so that we can provide you with the appropriate forms and addresses.
