Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythatthis project is consistent with the North Carolina Coastal Management Program.

Re: Objection to the Issuance of CAMA General Permit No.
37307-A to Bart Pierce, Lot 289, 50132 Kings Point Drive,
Brigands Bay, Frisco, Dare County
Dear Mr. and Mrs. Kulik:
This letter is in response to your objection, as an adjacent riparian property owner, to a permit
request from Mr. Bart Pierce for a pier, platform, and mooring pilings project in the Brigands
Bay Subdivision in Dare County. Dennis Hawthorn, of the Division of Coastal Management
(DCM) staff, was recently onsite to evaluate the permit applicant's request.
The permit applicant has requested a permit to build an 18-feet long by 6-feet wide pier with a
26-feet wide by 12-feet long platform at the end of the pier. The applicant has also requested to
place two (2) mooring pilings 10 feet out off the proposed pier platform. The pier structure, with
mooring pilings, will extend an overall distance of 40 feet beyond the existing shoreline and
bulkhead. Under the Coastal Area Management Act (CAMA), the Coastal Resources
Commission (CRC) has established Rules for General Permits for this type of development that
are found in 15A NCAC 07H .1200
You have notified DCM of your objections to this proposed development by returning an
adjacent riparian notification form that indicated you have objections to this proposal. Your
objections to this proposed development indicated that you believed the proposed pier structure
would interfere with the navigation channel of the canal where the project is proposed. I
understand that Mr. Hawthorn has left a message for you recently to discuss this permit decision.
He has also spoken by telephone to you quite some time ago about this proposal.
Mr. Hawthorn has reviewed your objections, along with all aspects of this development proposal
for consistency with the aforementioned Rules, which describe the CRC's standards and
guidelines for this type of development. Our review of the proposed development has found it to
be consistent with these Rules.
During Mr. Hawthorn's site visit, he noted that the width of the basin/canal is an approximate
distance of 300 feet across, which should provide adequate room for navigation within the canal.
The proposed dock will be offset at least 15 feet to the west of your lot and outside of the
adjacent riparian setback between your property and Mr. Pierce's property.

The permit for this proposed development has included conditions that limit the construction to
the design depicted on the project sketch, and require that all work on the pier, dock, and
mooring pilings remain outside of, and not interfere with, adjacent riparian corridors and
setbacks.
After having given careful consideration to your objections to this proposed development, we
have determined that the development is consistent with the Rules of the CRC and the State's
Coastal Management Program, and that all pre -requisites have been satisfied. Therefore, DCM
issued General Permit No. 37307-A on May 12, 2004, (copy attached) for the proposed
development.
If you wish to appeal this permit decision, you must file a Third Party Hearing Request Form
with the Director of the Division of Coastal Management within 20 days of the permit issuance
date. If you choose to pursue an appeal, please contact this office so that we can provide you
with the appropriate forms and addresses.
If you have any further questions regarding this matter, please do not hesitate to contact Mr.
