Any violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s) . The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available information and belief, certify that this project is consistent with the North Carolina Coastal Management Program. Ross Jr., Secretary April 15, 2004 Mr. Scott Patterson President Pelican's Perch LLC Post Office Box 3606 Prince Frederick, Maryland 20678 RE: Objections to the Issuance of General Permit to Install Sandbags Along Virginia Dare Trail in Kitty Hawk, Dare County Dear Mr. Patterson: This letter is in reference to your correspondence, received on March 24, 2004, objecting as an adjacent riparian property owner, to a request from the North Carolina Department of Transportation (NCDOT) to place sandbags along the east side of Virginia Dare Trail within the right-of-way. The bags will be placed two feet below the adjacent grade and under the pavement of the northbound lane of NC 12. Staff was recently on site and reviewed the NCDOT proposal, and noted that the section of Virginia Dare Trail, where sandbags are being proposed, qualifies as an imminently threatened structure to undertake temporary protective measures. Lynn Mathis reviewed the request for sandbags and found it consistent with T15A, Section 07H .1700: General Permit for Emergency Work Requiring a CAMA and/or Dredge and Fill Permit, of the North Carolina Administrative Code, The Division of Coastal Management has given your objections regarding the erosion control structure careful consideration and has determined that the project, as proposed, is consistent with the appropriate rules and regulations and that all prerequisite requirements have been met. The Division issued General Permit #37456A on April 15, 2004, to the North Carolina Department of Transportation (See Enclosed Permit). I can assure you that the placement of the sandbags will be in compliance with the Division's standards or wili be removed. The placement of the bags along NC 12 by NCDOT does not prevent Pelican's Perch LLC from undertaking the same, with a permit from the Division of Coastal Management If you wish to appeal this permit decision, you must file a Third Party Hearing Request form with the Director of the Division of Coastal Management within 20 days of the permit issuance date. Please note the three factors listed on this form, which need to be specifically addressed with additional attachments. Box 629 Raleigh, NC 27602-0629 If the Chairman of the Coastal Resources Commission grants a hearing of your appeal, you then must file a petition for a Contested Case Hearing with the Office of Administrative Hearings within 20 days of the Chairman's decision. This office can assist you with the forms and addresses associated with portion of the process. If the Chairman denies your hearing request, this decision can be appealed to the Superior Court in the county where the property is located.
