McDaniel of Cedar Lane, Cedar Point. I am very much opposed to this person's proposal. This could amount to a mini marina in my back yard with extreme noise and light polution. Also this individual does not even live on the property where the dock is to be built therefore he will have no regard to any noise or water polution that he and his friends and neighbors will cause. This basin I live on is already subject to water polutions due to the shape of the basin and the wind direction. It is my opinion that this proposed dock would cause great harm to the enviorment and the local area. It is not like there is no place for the individual to launch his boat. He lives approximately one -quarter mile from a public boot ramp. A free public boot ramp I might add. It appears that this individual has already assumed that your permission for this project will be granted. I understand that this individual has a house on Cedar Lane for sale. It is advertised as a waterfront lot. When I checked to see where the waterfront was I was told that Mr. McDaniel was building a new dock close to my property and that the new homeowner of that house would have rights to the water and the dock he is building. I have trouble understanding how this can be done. I strongly feel that an additional dock and/or boat lift in this small basin will be very harmful to the enviorment as well as cause additional property value loss to my property. I did not purchase my home to have a mini marina in my back yard. If this dock is built and open to numerous people residing on Cedar Lane the noise pollution will be unbearable. I do not wish to waiver the 15' setback requirement should the permit be issued. Again I would like to express my opposition to this proposed pier/dock. It would be very harmful to the enviorment and also a hazard to the health, welfare and peace of mind for my family. Regards. Ross Jr., Secretary May 26, 2004 Mr. Earl Keel 132 Palmetto Drive Swansboro, NC 28584 Dear Mr. Keel: This correspondence is in reference to your March 22, 2004 objection letter to the dock and boatlift proposal by your adjacent riparian property owner, Mr. James W. McDaniel. The project is to be located on a man made bay at 114 Cedar Lane in Cedar Point, Carteret County, North Carolina. Mr. McDaniel proposes to install a 5' X 30' access pier with a 13' X 13' uncovered boatlift at the site. It appears that your objections are based on your opinion that the project would cause great harm to the environment, would be a noise and light pollution problem to you and your family, and would cause property value loss. The North Carolina Division of Coastal Management has given your objections careful consideration but has determined that the project is consistent with the pertinent regulations of the Division. Therefore, on May 26, 2004, the Division issued CAMA General Permit #38053-C authorizing construction of the dock and boatlift. As permitted, the structure would be located at least 15' from your common riparian line.
