Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that I) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

Dear Sir/Madam:
The area Mr. Murphrey has proposed for construction is the last, very small, area of
wetlands that remains adjoining our property. During the past 6 months with cutting,
mowing and back filling, it has already been reduced in size significantly, probably in
preparation for this project.
It would be ecologically irresponsible to permit any further disruption within this tidal
marsh and wetlands area. Any destruction of this shoreline buffer zone and natural
wildlife habitat will serve no useful purpose for the future benefit of either of our
properties.
We strongly OBJECT to this proposal.

To Whom It May Concern:
This letter is in regard to the application for the construction of a pier by
Hiram G, Murphrey located on Paradise Shores Rd, After reviewing the
survey of the applicants property, which showed the proposed pier with the
single stroke of a yellow highlighter marker without measurements and other
location dimensions, I must object to the project on the basis of what was
illustrated. It is my opinion that the proposed pier would obstruct the marine
traffic coming and going into Dragline Bay. I also do not waive my 15'
setback requirement.

Richard, I went to Paradise Shores over the weekend and did some measurements, which
I have tried to depict on the attached survey but it is not to scale. I can make certain
assurances to you though. The white PVC Pipe on the left side of the navigational
channel going out of Dragline Bay is in excess of 60 feet from the adjacent
Murphrey/Wilhelm property line. I can also assure you that any part of the pier I propose
to construct adjacent to the Murphrey/Wilhem shoreline will be at least 30 feet or more
from the left side of the navigational channel going out of Dragline Bay. I assume that
these assurances can be enforced by CAMA. If you have further questions, call me

John, CAMA requested that I send you more detailed information on my proposed
construction of a pier on my lot at Paradise Shores. The pier will not violate the 15 foot
property line setback requirement. The length of the pier over water will not exceed 40
feet and will not exceed 6 feet in width. A 6 foot wide walkway attached to the pier, over
the marsh, from dry land of approximately 50 foot in length will be constructed and will
not violate the 15 foot setback requirement. I have tried to show you on the attached
survey where the pier and walkway will be located but it is not to scale. If you have any

John, CAMA requested that I send you more detailed information on my proposed
construction of a pier on my lot at Paradise Shores. The pier will not violate the 15 foot
property line setback requirement. The length of the pier over water will not exceed 40
feet and will not exceed 6 feet in width. A 6 foot wide walkway attached to the pier, over
the marsh, from dry land of approximately 50 foot in length will be constructed and will
not violate the 15 foot setback requirement. I have tried to show you on the attached
survey where the pier and walkway will be located but it is not to scale. If you have any

Dear Mr. and Mrs. Wilhelm:
This correspondence is in reference to your October 23`d and November 17', 2003
objection letters to the pier proposal by your adjacent riparian property owner, Mr. Hiram G.
Murphrey. The project is to be located on Dragline Bay in Paradise Shores, Pamlico County,
North Carolina. Mr. Murphrey proposes to construct a 6' X 90' pier with 40'. of that distance
over the open water at the above mentioned site.
The North Carolina Division of Coastal Management has given your objections
careful consideration but has determined that the project is consistent with the pertinent
regulations of the Division. Therefore, on May 26, 2004, the Division issued CAMA
General Permit #38843-C authorizing construction of the dock and boatlift. As permitted, the
structure would be located at least 15' from your common riparian line. I have enclosed a
copy of the permit for your perusal.
If you wish to appeal this permit decision, you may file a request with the Director of
the Division of Coastal Management, Department of Environment and Natural Resources
within 20 days of the permit decision. I have provided a copy of the pertinent form if you
choose to file a request with the Director. If you have any questions regarding this matter,
please don't hesitate to contact me at my Morehead City Office (252-808-2808).
