Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythatthis project is consistentwith the North Carolina Coastal Management Program.

This letter is in reference to your response on a returned adjacent riparian landowner notification
letter regarding proposed development at Lot 29, Hammock Village, Pirates Cove Subdivision, Manteo,
Dare County, North Carolina and adjacent to a manmade canal off Shallowbag Bay. The applicant, Mr.
A. R. Curtis proposes to construct a bulkhead on his property (lot 29) from property line to property line.
The purpose of the bulkhead is for shoreline stabilization and to prevent flooding. The bulkhead is to be
placed landward of any wetlands and Mr. Frank Jennings of my staff has confirmed a bulkhead alignment
that does not impact he adjacent shoreline wetland fringe.
Although none of our current rules address bulkhead height, Mr. Curtis' proposed bulkhead will
be approximately the same height as the area you have on the side next to Mr. Curtis. You have placed or.
caused to be placed several pieces of 6" x 6" blocks to form a rectangular area, which is filled with dirt
and grassed over next to Mr. Curtis. His proposal does not appear to be inconsistent with your existing
yard elevation.
Therefore, the Division of Coastal Management has given your objections careful consideration
and has determined that the project as proposed is consistent with the appropriate rules and regulations
and that all pre -requisite requirements have been met. Consequently, the Division issued a General
Permit (copy attached) on December 11, 2002 to Mr. A. R. Curtis for bulkhead construction.
If you wish to appeal this permit decision, you may file a request with the Director of the
Division of Coastal Management, Department of Environment and Natural Resources within 20 days of
the permit decision. If you have any questions regarding this matter please don't hesitate to contact me in
the Elizabeth City Field Office at (252) 264-3901.
