Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

Attached is General Permit #C-33692 to install an 8' x 14' dock in Carteret County adjacent to
John's Creek within the Rush Point S/D at 142 Rush Point Road, Harker's Island, NC.
In order to validate this permit, please sign all three (3) copies as indicated. Retain the white
copy for your files and return the signed yellow and pink copies to us in the enclosed, self-
addressed envelope. If the signed permit copies are not returned to this office before the initiation
of development, you will be working without authorization and will be subject to a Notice of
Violation and subsequent civil penalties.

As I have discussed with Ms. Barrett, our client, Mrs. Ann W. Davis, has been asked by Mr. Cidlowski
to execute a waiver form in connection with his proposal, as shown on the attached copy of a map which he
provided, to extend a dock from an existing Net House shown on the map.
As I referenced in the previous letter, Mrs. Davis has not been involved with the surveying provided by
Mr. Cidlowski and does not want to waive any right she has to object to a dock which does not meet the 15-foot
setback requirement. She renews her objection to any dock or extension which would not meet this requirement.
That being said, however, she understands from Ms. Barrett that, if the Division of Coastal Management
finds that the dock is not within the 15-foot setback requirement, then the Division may approve the request
without regard to Mrs. Davis' approval or objection. We understand that the Division will make this
determination independently, and we request that the Division notify me if it decides to approve the request on
this basis.

Dear Ms_ Barrett;
Thank you for reconsidering my request to build a small dock at 142 Rush Point
Road. First let me point out that the property shown on die enclosed map is a single lot
and not two separate lots as the first document T sent to you suggested. The line on the
original drawing demarked an easement to the previous owner. We now propose to
extend the existing net house (dimensions 12ft by 12ft) by building a 1Oft by 12ft
extension that will be completely in Johns Creek. The extension will be in completed
accord with CAMA specifications. Please see the enclosed map that includes -the original
net house and the extension we wish to build. Thanks for considering this request.

As we have discussed with Ms. Barrett, we understand Mrs. Davis' telephone conversation with Mrs.
Barrett constitutes Mrs. Davis' official notice of her initial objection to the proposal provided to her by Mr.
Cidlowski, a copy of which is attached hereto, and this letter shall constitute further evidence of such notice of
objection having been made in a timely manner. We understand that Ms. Barrett will be investigating the request
later this week and will contact me after she has had an opportunity to review the proposal.
In the meantime, we would be interested in receiving the "description or drawing, with dimensions"
(emphasis added) required by the notice. The drawing sent to Mrs. Davis has no dimensions and no description
from which she could determine whether the proposed dock would interfere with her access and use of the basin.
We note that a survey in Mrs. Davis' possession does not agree in all particulars with the one provided by Mr.
Cidlowski. We note that the areas depicted as the "Existing Doc" and "Proposed Extention" are hand drawn and
not part of the formal survey. There can be no assurance that they properly reflect the location ofthe existing dock
or the proposed extension. If there are additional materials which show the proposal with some precision, we
think Mrs. Davis is entitled to those for her review.

Dear Ms. Barrett and Mr. Cidlowski:
As we have discussed with Ms. Barrett, we understand Mrs. Davis' telephone conversation with Mrs.
Barrett constitutes Mrs. Davis' official notice of her initial objection to the proposal provided to her by Mr.
Cidlowski, a copy of which is attached hereto, and this letter shall constitute further evidence of such notice of
objection having been made in a timely manner. We understand that Ms. Barrett will be investigating the request
later this week and will contact me after she has had an opportunity to review the proposal.
In the meantime, we would be interested in receiving the "description or drawing, with dimensions"
(emphasis added) required by the notice. The drawing sent to Mrs. Davis has no dimensions and no description
from which she could determine whether the proposed dock would interfere with her access and use of the basin.
We note that a survey in Mrs. Davis' possession does not agree in all particulars with the one provided by Mr.
Cidlowski. We note that the areas depicted as the "Existing Doc" and "Proposed Extention" are hand drawn and
not part of the formal survey. There can be no assurance that they properly reflect the location of the existing dock
or the proposed extension. If there are additional materials which show the proposal with some precision, we
think Mrs. Davis is entitled to those for her review.

Dear Mr. Garland:
This correspondence is in reference to your February 25, 2003 objection letter on
behalf of Ms. Ann W. Davis to the proposed construction of an 8' X 14' dock adjacent to
Mr. Cidlowski's property at 142 Rush Point Road, on Harker's Island, Carteret County,
North Carolina. Mr. Cidlowski proposed to construct the dock on John's Creek at Rush
Point within his riparian area and more than 15' from the joint riparian line with Ms. Davis.
It appears that the objections are based on your opinion that the project may encroach
within that required 15' riparian setback. The North Carolina Division of Coastal
Management has given your objections careful consideration and has determined that the
project is not within the 15' required setback and is consistent with the pertinent regulations
of the Division. Therefore, on March 12, 2003, the Division issued CAMA General Permit
#33692-C for construction of the dock.
If you wish to appeal this permit decision, you may file a request with the Director of
the Division of Coastal Management, Department of Environment and Natural Resources
within 20 days of the permit decision. If you have any questions regarding this matter, please
don't hesitate to contact me at my Morehead City Office (252-808-2808).

As I have discussed with Ms. Barrett, our client, Mrs. Ann W. Davis, has been asked by Mr. Cidlowski
to execute a waiver form in connection with his proposal, as shown on the attached copy of a map which he
provided, to extend a dock from an existing Net House shown on the map.
As I referenced in the previous letter, Mrs. Davis has not been involved with the surveying provided by
Mr. Cidlowski and does not want to waive any right she has to object to a dock which does not meet the 15-foot
setback requirement. She renews her objection to any dock or extension which would not meet this requirement.
That being said, however, she understands from Ms. Barrett that, if the Division of Coastal Management
finds that the dock is not within the 15-foot setback requirement, then the Division may approve the request
without regard to Mrs. Davis' approval or objection. We understand that the Division will make this
determination independently, and we request that the Division notify me if it decides to approve the request on
this basis.
