Ross Jr., Secretary June 27, 2003 Mr. Earl Keel 132 Palmetto Drive Swansboro, NC 28584 Dear Mr. Keel: This correspondence is in reference to your June 19, 2003 objection letter to the pier/dock proposal by your adjacent riparian neighbor, Mr. James W. McDaniel. The project is to be located on Hills Bay at 114 Cedar Lane in Cedar Point, Carteret County, North Carolina. Mr. McDaniel proposes to install a 4' X 37' access pier with a 13' X 13' uncovered boatlift at the site. Although the pier would be located in the Public Trust Waters of Hills Bay, it would on the other hand be located on private bottom owned by Ms. Candace Camus. Ms. Camus has granted permission for Mr. McDaniel to construct the pier over her private bottom. It appears that your objections are based on your opinion that the project would cause great harm to the environment and would be a health and welfare hazard to your family. The North Carolina Division of Coastal Management has given your objections careful consideration but has determined that the project is consistent with the pertinent regulations of the Division. Therefore, on June 24, 2003, the Division issued CAMA General Permit #34502-C authorizing construction of the pier/dock. If you wish to appeal this permit decision, you may file a request with the Director of the Division of Coastal Management, Department of Environment and Natural Resources within 20 days of the permit decision. Cama Offical: I am writing to complain for a destruction of a large area of wetland and marsh grass. The individual that lives on the basin on Palmetto Drive in the first house on the right after turning off Hwy 24 has destroyed two large sections of marsh grass that we have worked for years to protect. This individual dug up the marsh grass to make room to park two of his or someone's boats. Inclosed are two pictures taken from my back yard across the basin. Everyone else in the area has live with the fact that they can not destroy the grass along the water which is prime feeding areas for small fishes. I feel that immediate action should be taken before this individual decides to destroy more grass and destroy more of the environment which we as locals enjoy so much. This individual iiproposing building a pier and boat lift in the water adjacent to his property. If this comes about there is no telling how much damage he will do with this mindset he has. McDaniel of Cedar Lane, Cedar Point I am very much opposed to this person's proposal. This could amount to a mini marina in my back yard with extreme noise and light polution. Also this individual does not even live on the property where the dock is to be built therefore he will have no regard to any noise or water polution that he and his friends and neighbors will cause. This basin I live on is already subject to water polutions due to the shape of the basin and the wind direction. It is my opinion that this proposed dock would cause great harm to the en-iorment and the local area. It is not like there is no place for the individual to launch his boat. He lives approximately one -quarter mile from a public boot ramp. A free public boot ramp I might add.. It appears that this individual has tried this proposal on numerous occasions under different names. I have received this same proposal under at least three names- I think this proposal should not go any further and any further proposals for this project should be rejected - Again I would like to express my opposition to this proposed pier/dock- It would be very harmful to the enviorment and also a hazard to the health welfare and peace of mind for my family. I am grossly opposed to this proposal. This is a very small body of water that I live on. I have been here for fifteen years and during this time pollution has been a constant problem due to the size, shape, layout and direction for the winds here. Boats come in and out of this body of water but not often. With this proposed boatlift, pier and dock there will be numerous vessels in this body of water permanently and the pollution will be extremely harmful to the water life in this area. This body is a safe haven for small fishes and other water life. This proposal could very easily become a public boat launching area for numerous people on Cedar Lane in Cedar Point who could very easily utilize the Wildlife public boat ramp just a few hundred yards up Hwy 24. The pier could easily become a gathering place for the area fishermen. The noise from this proposal is not a pleasant prospect for our quite, peaceful community. The harmful effect of a lot of boats in this body of water is not the only problem. My home is only a few feet from the water's edge and the noise of boats running in and out of my back yard could become a hazard to my health and the health and welfare of my family. During my fifteen years living here I have had a constant problem with people from Cedar Lane wanting to put their boats in the water over my property. This has been done without my knowledge and shortly became an area of erosion and was causing the erosion of our street, Palmetto Drive. I have had to fill in the area at the road on a number of occasions due to rainwater washing out my property between the road and the water. This proposal will cause erosion of the entire strip along the roadside next to the water. This proposal is not a good idea in any sense of the word. Again I oppose to this proposal or any construction that will become a nesting area of numerous pollution causing boats. CALL TO ORDER The special meeting of the Governing Body was called to order at 4:00 p.m. Present were: Mayor Paul Edgerton, Commissioner Elbert Benton, Commissioner Robert Fisher, Commissioner David Russell and Commissioner Andy Underseth. Also, attending were Interim Manager -Harry Pugliese, Deputy Clerk -Paula Webb, and representatives from the Daily News and Tideland News. 2. BUSINESS Mayor Edgerton noted that the purpose of this meeting is to announce that the Governing Body has selected a Town Manager. Commissioner Fisher made a motion that Edward L. Faison be appointed as Town Manager effective August 21, 2001. Commissioner Benton seconded the motion. There was a unanimous vote of approval. At this time Mr. Faison took his position at the Board table. The contract agreement was executed at this time. Mr. Faison thanked the Mayor and the Board for the opportunity to serve them and the Town of Swansboro. He added that he is looking forward to being a part of the community. 3.
