Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

Dear Mr. Buckley:
This correspondence is in reference to the permit issued to you for your pier and
boathouse project involving the replacement of a 5' X 36' derelict dock and the construction of
a 20' X 20' boathouse with two floating docks measuring 10' X 10' and 4' X 30. The project
location is on a canal off Holly Creek and the Neuse River, at 557 China Grove Road, near
Arapahoe, Pamlico County, North Carolina.
I am writing to let you know that the petitioners who challenged the location of your
pier have decided not to pursue their appeal in the Office of Administrative Hearings.
Accordingly, your permit is no longer suspended under NCGS 113A-121.1 (c). I encourage
you to work with the petitioners to address any navigational concerns, though you are free to
undertake development on the pier structure at any time.
Based on my calculations, the permit was on hold for 36 days, therefore the new
expiration date for CAMA General Permit #33963-C is September 6, 2003. Thank you for
your continued cooperation in this matter and for your efforts to comply with the permit
requirements of the Divisions. If you have any questions regarding this matter, please don't

Management (DCM) has reviewed all the information submitted to this office and it appears
that the project as proposed meets the so-called "'/a rule" and as such it appears that it would
not adversely affect traditional navigation down the center 1/2 of the canal. Therefore, on May
1, 2003, the DCM issued General Permit #33963-C to Mr. Buckley authorizing the proposed
development.
Enclosed you will find a copy of the permit with specific conditions. If you wish to
appeal this permit decision, you may file a request with the Director of the Division of Coastal
Management, Ms. Donna Moffitt, Department of Environment and Natural Resources within
20 days of the permit decision. I have enclosed a copy for your use if you so desire. A faxed
copy of the appeal is acceptable. If you have any questions regarding this matter, please don't

Re: Suspension of Work / Appeal of CAMA Permit Decision
Dear Mr. Buckley:
The Chairman of the Coastal Resources Commission, Eugene Tomlinson, has received
two requests for administrative hearings to challenge CAMA General Permit 33936-C. The
Third Party Hearing Requests were filed on behalf of petitioners J. D. Umstead and O. Edward
Dixon on May 20, 2003. Under N.C.G.S. §113A-121.1 (the Coastal Area Management Act),
your CAMA permit is automatically suspended upon receipt of a hearing request and will remain
suspended until either: (1) the Chairman denies the hearing request (under standards set out in
the statute); or (2) there is a final Coastal Resources Commission decision on the permit
appeal. You may not undertake any development under the permit until further notice after
Chairman Tomlinson issues his decision.
The Division of Coastal Management will prepare a recommendation for the Chairman
on whether to grant or deny the hearing request. The Chairman must make a decision within 15
days after receipt of the hearing request, in this case no later than June 4, 2003. If you wish to
submit any materials for the Chairman's consideration in ruling on the request for contested
case hearing, please send them to me as soon as possible.
