I have met with my adjacent property owner David McCabe of the Town of Morehead City and reviewed my plans with him. He is reviewing my diagrams and will mail his signed Owner's Statement to me soon. My other adjacent property owner, Edith Ann Berry has requested that I mail her the information, her Owner's Statement, as well as the CAMA general permit guidelines. A copy of my postal receipt is enclosed as is a copy of some information I sent to Mrs. Berry which addresses concerns she expressed to me September 2002. I will mail to you the executed Owner's Statements as soon as I receive them as well as the Postal Signature Card showing receipt by Mrs. Berry. The pier would be constructed using 67 width wooden deck planks. I am requesting permission to construct the pier to a total length of 216' to 224' which would take it to the edge of the deeper water channel. The additional length would provide me approximately an additional 2' of water depth at the end of the dock. The exact length would be determined based on the actual location of the vegetation line. On my drawing, I have also shown the construction of an elevated slatted boardwalk which would be built over the Spartina sea grass which I have planted along my Southern boundary. The boardwalk would be built using 6' 0" width deck planks. The pier and boardwalk would both be constructed to begin and end flush with the beach area. I wanted to share with you the information on the dock that I am planning on having built in from of my home at the end of 19th Street Back in September 2002, I came to visit you at which time you had some concerns regarding your ownership of the submerged lots in Bogue Sound and also any conveyed liability to you should an injury occur on the dock that I proposed to build. I hired John Harris of The Harris Law Firm in Morehead City to fully research these issues for me. A copy of his letter is attached for your review which addresses each point quite clearly. Also attached is a copy of the UNC Sea Grant BLUEPRINTS bulletin #UNC-SP-BP-92-01 which outlines one's riparian rights and private ownership of land in the public trust waters of North Carolina. During my visit, I wanted to show you the diagrams which I have prepared as part of my application for a CAMA General Permit. I have two configurations shown that I would like to explain. Diagram A shows the dock centered on my lot and preserving the 15' side setbacks. This configuration locates the boat slip and the boat lift on your side of the dock. Diagram A also shows the adjacent platform located on your side of the dock. Diagram B is my preferred configuration. It shows the dock offset to the East and built within the 15' setback. This configuration allows us to move the platform farther away from your home and puts in on the West side of the dock. CAMA requires me to notify my adjacent property owners outlining the project and have each sign an Owner's Statement. If you would please, how about reviewing each Diagram, signing the actual Diagram of your choice, signing the Owner's Statement and then returning them to me in the enclosed envelope. You do have the opportunity to make any comments on the development in writing for consideration by permitting officials to the Division of Coastal Management within 10 days of receipt of this information. As you mentioned, Ms Edith Berry has a deed for lots that are apparently under the waters of Bogue Sound and below the high-water mark of the sound. I reviewed the Register of Deeds records briefly and also the Carteret County Tax Office and found the following: a. A 1997 deed from The Edith Berry Family Limited Partnership to Edith Berry recorded in Book 798 at page 328 (copy enclosed). This deed includes 2 separate parcels; one being her property adjacent to yours and above the high-water mark and the 2nd parcel consisting of lots south of your property and apparently below the high-water mark of the sound; b. A 1976 deed for the same 2 parcels from Gus Davis, Commissioner to Edith Berry and her husband Jennings Berry. (copy enclosed); C. A tax parcel card for tax parcel 46386.17.20.4641000 for the parcel of property identified as lots 6-10 Bk. 137, the parcel south of your property. This parcel is identified as marshland on the parcel card and is given a tax value of $174.00. I have included the tax card and a copy of the tax map identifying the property. I did not complete a full title search on her property and do not have any history on the property other than the above and my opinions are limited to reviewing the above documents and are also based upon the assumption that your deeded property actually is adjoining the high-water mark of Bogue Sound and that a current survey would show this fact. You have advised me that you have such a survey and it has been recorded. Based upon the above assumptions and limitations, you, as a landowner of property that fronts on the waters of Bogue Sound are given certain riparian right, and one of those right is the right to construct a pier to access deep water. These rights are limited and you cannot, by exercise of these rights. adversely affect adjacent riparian UR 0 4 2003 owners rights, the rights of the public to use of the waters of Bogue Sound and the right of fisherman and recreational users of those same waters. As you know, before you exercise these rights, you must obtain various permits, including CAMA permits, which also contain limitations and restrictions on use, location and size of structures in public trust waters. Rather than give you an extensive treatise on the laws of riparian landowners, I have provided you with a brochure by UNC Sea Grant, which provide a good overview of these rights. As to the issue of ownership of lands south of your property by Ms. Berry and completely under the waters of Bogue Sound, the law in North Carolina is quite clear. Lands beneath coastal waters, including navigable waters of Bogue Sound, are owned by the State of North Carolina (see Miller v. Coppage 261 NC 430 —1964 and the Federal Submerged Land Act of 1953). These lands are held under the "Public Trust Doctrine." Absent a grant from the State of North Carolina which specifically limits public trust rights, a deed to submerged land to a 3`' party in which the Grantor is not or has not been the State of North Carolina is void and has no effect to transfer title. (Except for certain transfer made by a few Board's of Education in the early 19007s). Certain leases are granted by the State to submerged lands and I am making the assumption no such leases exist in favor of Ms. Berry. Therefore, since she has no ownership rights, it would follow that she would have no liability for any actions that occur because of your exercise of your riparian rights on these public trust waters. However, Ms Berry. as an adjacent riparian landowner, must be notified if any construction takes place that requires a C AMA permit and she can assert objections that she may have if she believes your pier would interfere with her rights as an adjacent landowner. I hope this answers you questions. I did not attempt to address the issues of plated streets adjacent to your property that may or may not be owned by Morehead City since you indicated that your previous actions in recording a plat of your property have addressed this topic. Upon her request, I mailed this information to my other adjacent riparian property owner, Edith Ann Berry per the outline in the CAMA general permit guidelines. Her signed postal signature card dated March 6, 2003 and her signed Owner's Statement are attached. My private dock configuration does not utilize either 15' side setback. The private dock would extend from an origination point on the beach to a finished length of 240 feet. This length would span across the shallow waters and take the dock to the north edge of the channel thus providing access to deeper navigable waters. As requested, a chart showing normal low tide Depth Soundings taken at 5' intervals is attached showing the water depth along the length of the proposed dock. A new Riparian Corridor Survey has been prepared by Powell Surveying of Beaufort and is attached. The slated elevated slatted boardwalk would be built from the St. Augustine/Spartina division line in my yard to the point where the dock begins on the beach. I hope that this information will satisfy the requirements for a CAMA General Permit. I do appreciate your consideration of my requests. After reviewing the permit with my contractor, I would like to make a couple of amendments to our development. One amendment is t t we plan to ins al ingle story slo d roof over the section of the platform and dock. It w�prtion nstructed si ar to the one . the enclosed picture. This would provide shade anfrom the sun. Our next clarification is that we would like to position the shown platform on the East side of the dock to a distance of 32 feet from the Southern end of the dock. This design was shown on my original hand drawn plan but without dimensions. This allows us to recess the first pilings for the single overhead boat lift from the end of the dock so that the boat's engines will not hang out beyond the end of the dock. Our other amendment is that we want to install a sing et boat lift using side mounted tracksC d motors pyd a single c n ' ous bunk. Thh lift ' be locate the same location as the forked lifts w n Youplclrawin4,and will commodate e boat. I have mailed a letter to my adjoining riparian property owners, Edith M. Berry and the Town of Morehead City notifying them of our amendments and clarifications and outlining CAMA procedures regarding comments.
