Any violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s) . The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available information and belief, certify thatthis project is consistent with the North Carolina Coastal Management Program. The Dock Committee will need to review plan and elevation sketches before giving final approval for the boat -lift. 2. The bast -lift will not be used for boats longer than 30 Beet LOA_ 3. You wiTbe responsible for arranging all permits, selecting and managing the contractor; paying all costs and completing the project to the satisfaction of the Association- 4. You may enjoy the use of Slip E5 and boat -lift as long as you continue your membership in the Association. At such time as you no longer require the boat -lift or are no longer a member of the Association, you will be required to return the slip to its original condition. An exemption may be granted if you sell the boat -lift to another member of the Association_ 5. Prior to commencement of installing the boat -lift you must set up an interest - bearing escrow account at a mutually agreed institution to insure funding for the return of the Slip B-5 to original condition after you no longer require the boat -lift or are no longer a member of the Association. You will provide escrow money equal to 25 percent of the contract price for the project. Any unspent money, including accumulated interest after returning the slip to original condition, will be returned to you- If the escrow money, including accumulated interest, is insufficient to pay the full cost, you will be required to pay the difference. You will be responsible for any taxes due on interest paid.
