Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available

Carteret County
Dear Mr. Butt:
Thank you for your correspondence dated November 30, 2001, and received via FAX
on December 3, 2001. Your letter requested assistance from the Division of Coastal
Management (DCM) to alleviate an encroachment dispute between yourself and an
adjoining property owner. This office has reviewed your request and determined that
DCM has no jurisdiction in this matter and that no further action will be taken. Your
efforts to remedy the situation via the Carteret County Department of Planning &
Inspections or through individual legal action may be your best approach.

Dear Mr. Jones:
I own a home on Bogue Sound at 1663 Highway 24 East, Newport, North
Carolina, 28570. I would greatly appreciate your help and influence regarding a problem
I have with the Carteret County Board of supervisors and with Claude R. Wheatly, the
County Attorney.
Mr. Bevin Nall, a local real estate attorney, has built his garage over on my
property and the county refuses to make set -back remove often feet.s structure to conform with the
R2 Zoning District which requires a
Mr. Wall has received a certified letter from Katrina F. Marshall the Director of
planning and Inspections (copy enclosed). This letter states that he did not have a
building permit to build the garage and in a letter to the county admits that he encroaches
on my property. I have made numerous attempts to have this problem corrected but no
action has taken place. The county attorney and Board of Supervisors have not taken any
action against Mr. Wall and told me they do not intend to be involved.
Anything you can do to help me resolve this problem which has be fmgoi g On for
seven years would be greatly appreciated. I have no plans to sell him any y
land to
resolve this problem. I want him to move the garage and to comply with the set -back
requirements of the county.

After a review of your letter dated Larch 25, 1999, written to Building inspector Chris Jones, the
staff has further investigated the status of the garage on your property (PIN 6336.04-62-7652).
No records are on file for the construction of the garage. Also, your letter confirms the garage
encroaches in the required setback. Your property is located in the R-20 zoning district which has
a side setback requirement of ten (10) feet.
You have tW option to request a variance from the Zoning Board of Adjusuneat if you fed the
encroachment is based an a hardship. If you choose this option, you need to schedule an
appointment with me to discuss the matter and receive the necessary application forms,
You mentioned in the letter dated March 25; 1999 that you are in the process of trying to rou;b a
solution that would cure the setback problem. If this has occurred, please wbmit proof to the
DeWment of Planning & Inspections.
