violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowners).

8. PROJECT SUMMARY: The applicant proposes to relocate and enlarge a pier which was destroyed by
Hurricane Fran. The pier will provide mooring facilities for 10 boats. A high -round retaining wall is
also proposed.

9. NARRATIVE DESCRIPTION: The applicant's property is a ± 18 acre tract of land
located at 546 Cedar Point Blvd (NC Hwy. 24) and in the Town of Cedar Point, Carteret
County. The property is also located immediately west of NC Hwy. 58 and is bordered
on the south by Bogue Sound. The upland property has been developed into a ± 87 lot
mobile home park. There is an approximately 375' buffer area between the closest
mobile home and the waters of Bogue Sound. This buffer area is vegetated by lawn
grasses and pine trees which were severely impacted by last years hurricanes. An
approximately 10' wide gravel roadway transverses through this area and provides
vehicular access to the shoreline. A ± 10' wide circular turn -around is located at the
end adjacent to the water. An 18" diameter stormwater discharge pipe is located ± 20'
away from the wetland/waters edge with its discharge being dissipated by a rock splash
apron. The applicant's shoreline consists of an approximately 20' to 50' wide border of
Coastal Wetlands vegetated primarily by juncus roemerianus with scattered amounts of
spartina altern�flora and spartina patens. Landward of the marsh, there potentially exist
a 0 to 10' border "404 wetlands". A ± 8' to 10' wide x ± 30' long section of the
wetland border has been denuded of vegetation by historic boat launching. Scattered
oysters are located along the intertidal zone and a review of the aerial photography revels
the presence of submerged aquatic vegetation in the nearshore subtidal area.
Immediately offshore of the property are the remnants of a ± 125' long x 4' wide pier
which was destroyed by Hurricane Fran. The applicant indicated that 4 to 6 boats would
tie up to the pier on an informal basis. The waters of Bogue Sound in front of the
applicant's property has been classified as SA ORW and are open to the harvesting of
shellfish. Between the applicant's property and the Atlantic Intercoastal Waterway are a
series of marsh islands with the closest one being ±600' offshore.
The applicant is requesting a permit which would allow for the relocation and extention
of the pier which was destroyed by Hurrincane Fran. The pier is proposed to be
relocated ± 40' west of its former location. The pier is also proposed to be extended
approx. 35' futher into Bogue Sound making the total length of pier beyond the mean
high water line to be ± 165'. Four finger piers with associated mooring pilings are
proposed to be constructed off the main pier and will provide pernament mooring tie-up
areas for 10 boats. At the waterward end of the pier, a 50' long x 10' wide "T" platform
is proposed which would be in water depths of -4.7' at mean low water. The pier would
be located approx. 23' away from the western adjacent property owner's area of ripiarian
access and ± 40' away from the highway/bridge right of way.
The applicant is also proposing to construct an approx 10' wide x 83' long concrete boat
ramp which will be located in the area which has been impacted by the historic boat
launching. The proposed boat ramp would fill a ± 50 sq. ft. area of vegetated wetlands,
a ± 280 sq.ft. wetland area which is denuded of vegetation and ± 150 sq.ft. of subtidal
bottom area. A ± 160' of wooden retaining wall is proposed to be constructed on
highground behind all wetland vegetation. The cirlcuar drive would provide access to
the boat ramp and would be relocated and expanded in a northerly direction by ± 70' .
A 75' long x 50' wide gravel parking area is proposed to provide vehicular access to a
passive park area which will be located between the parking lot and the water. The
parking area would be located ± 210' landward of the mean high water line.
10. ANTICIPATED IMPACTS: The project as proposed will result in the relocation and
extension of a pier into the waters of Bogue Sound to service an 87 lot mobile home
park. The pier will be designed to have a 500 sq. ft. "T" at its waterward end and
finger piers and mooring pilings to accommodate 10 boats. The pier will not exceed
beyond one- third the width of the water body (measuring across from the mainland to
the closest marsh island). The proposed boat ramp will result in the direct filling of ±
50 sq.ft. of Coastal Wetlands and ± 280 sq.ft. of an unvegetated wetland area which
has been impacted by boat launchings over the years.. The proposed boat ramp would
also fill ± 150 sq. ft. of shallow water bottom area and result in ± 5 cu. yds of concrete
material being placed below the mean high water line of Bogue Sound. The boat ramp
will terminate in waters ± 1' deep at mean low water and would not be very conducive
for boat use at that time. The proposed modifications to the existing gravel driveway
and the 10 car parking area will result in ± 5,100 sq.ft. increase of built upon surface
area within the Estuarine Shoreline adjacent to the Outstanding Resource Waters of
Bogue Sound. The applicant has indicated that the total built upon area (with the
proposed improvements) would be 21.2 % of the AEC area. The proposed bulkhead will
be located above all Coastal and "404" wetlands. It is estimated that highgound
disturbances associated with the parking, boat ramp and bulkhead backfill will
encompass an area of ± 8,000 sq.ft.
