Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

envelope. If the signed permit copies are not returned to this office before the initiation of
development, you will be working without authorization and will be subject to a Notice of

This letter is requesting a General Permit .1100 be issued for 112' of
shoulder/shoreline stabilization along NC 94 in Hyde County. The stabilization will occur
on an eroded bank that has collapsed along NC 94 causing the shoulder of the road to
become unstable. The Division of Coastal Management considers the project area to be
within an AEC that requires authorization for the shoulder stabilization. Included with
this request are the MP-1, MP-2 forms, location map, landowner notices, and permit
drawings depicting the proposed work. WBS element # is 1.104811. If any additional

The NC Department of Transportation is proposing to stabilize 112' of shoulder
along the east side of NC 94 in Hyde County. The shoulder of the road is eroding away
and needs to be stabilized to prevent further erosion and unsafe driving conditions. The
project is located 0.4 miles north of SR 1307 (Seth Rd), adjacent to the Fairfield Canal
pump house.
The Division of Coastal Management (DCM) considers this to be in an "Area of
Environmental Concern" under their regulations. Therefore, it is provided protection
under state law. For this reason the NCDOT will apply for a permit from the DCM to
perform the described work. Part of the permit process is notifying the adjacent
landowners of the proposed work. A map depicting the project area, along with a design
plat, and the permit application is included with this letter. If you have any questions
