Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

We are proposing to install a new 415' long wooden seawall with approximately 5' of exposure
at 101 Trent Shores Drive in New Bern, NC. This wall will run across the entire shoreline of the
property. Please see the attached aerial photo. The dashed line represents seawall placement.
We are also proposing to install a new 5' wide by 60' long pier with 12' wide by 16' long Ell,
two (2) new boat lifts and four (4) 30' long pilings for a future boathouse.

dated August 9, 2012, received August 13, 2012, regarding an Adjacent Riparian Property Owner
Notification/Waiver form.
This letter is to inform you that your request will need to be reviewed and discussed by the partners of
the LLC before it can be answered by one of the managing partners. Since several of the partners reside
out of state, it will take more than the requested 10 days to develop a response. At this time you
should treat this letter as an objection to the request and notice that the LLC is not waiving the 15'
setback requirement.

construction to be performed for Mr. Sean Murphy at 101 Trent Shores Drive, New Bern, NC.

paid envelope provided.
The return time for this request is ten (10) business days. We would appreciate your reply at
your earliest convenience.
We will be installing a 415' long wooden seawall with approximately 5' of exposure. This wall
will run across the entire shoreline of the property. Please see the enclosed aerial photo. The
dashed line represents seawall placement. We are also installing a 5' wide by 60' long pier with
