Any violation of these terms may subject the permittee to a fine, '° applicant's signature imprisonment or civil action; and may cause the permit to be- come null and void. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that 1) this pro- ject is consistent with the local land use plan and all local ordinances, and 2) a written statement has been obtained from adjacent riparian landowners certifying that they have no objections to the proposed work. Box 1567 Washington, NC 27889 Mr. Moore, This letter is in reference to Storm Damage Permit 23337B that I issued to you on 7 October 1999 for replacement of the pier and repair of a jetty (wooden groin) at your property located off SR 1315 at Edgewater Beach on the Pamlico River in Beaufort County, North Carolina. North Carolina Administrative Code (NCAC) 710210 states, in part, "The proposed work will be considered replacement if the cost of the proposed work exceeds 50 percent of the physical value of the structure at the time of damage." Based on an 1 I October onsite inspection by Terry Moore, District Manager of the Washington Regional Office, and me, it was determined that the proposed work on the jetty would constitute replacement of the structure. Replacement of the structure is allowed under a storm permit, however, the structure will be required to meet current rules. I have included a copy ofNCAC 7H.1400 which outlines the specific dimensions allowable under current regulations. A permitted jetty cannot extend more than 25 R waterward of the normal water level, and the height of the structure may not exceed 1 ft above normal water Ievel. I have modified your permit according to the regulations and have included a copy of the modified permit with this letter. I have also forwarded a copy of the modified permit to Mr. Boyd Sprouse, your contractor for the proposed project. Thank you for your time and cooperation in resolving this matter.
