may subject the permittee to a fine, imprisonment or civil action; and
may cause the permit to become null and void.
This permit must be on the project site and accessible to the permit of-
ficer when the project is inspected for compliance. The applicant certi-
fies by signing this permit that 1) this project is consistent with the local
land use plan and all local ordinances, and 2) a written statement has
been obtained from adjacentaiparian landowners certifying that they
have no objections to the proposed work.
In issuing this permit the State of North Carolina certifies that this project
is consistent with the North Carolina Coastal Management Program.

I writing this letter (hopefully) to clear up some of the confusion on the dock
permit that I am asking CAMA to grant. I understand exactly where the property lines
are and there are two large metal stakes on the back of the property in full view. I
believe the confusion is from the drawing that Outer Banks Marine Construction
submitted. That drawing "is not" drawn to the specifications of the lot, and would leave
someone to believe that the concrete bulkhead represents the property lines, which it
does not.
I fully expect to comply with Mr. Gary Plough's concern of honoring the 15'
setback on the crest side of the property and I have received the east side property
owners permission to have the outer pilings within the east side's setback area. The
property is 60' wide and the new dock is asking for 38' from outside piling to piling.
There will be 15' (or wider) on the west side from the lot stake (not end of bulkhead) and
7' from the east property stake.
I will also make sure that the Outer Banks Marine Construction Co understands
Mr. Plough's concern that they will be responsible to build the dock within these stated
parameters.
I certainly would appreciate any help that I can get to resolve any concerns that
CAMA or my neighbors may have. Please call me if you need any additional
information is needed, thank you.

Dear Sir:
We own the adjacent property, west side, to 145 Pond
Drive, and we do object to the enclosed drawing. The
property line shown on the drawing is incorrect. On
the west side bulkhead, showing on the enclosed drawing,
this property line should be moved 42 inches East. As
shown on the drawing the pilings on the West side of the
wet slip will be less than the required 15 feet off the
property line.
We would appreciate your help in resolving this matter.

We do not understand how CAMA can issue a permit based on
the plan that was submitted, when both parties concerned
agree that the plan is incorrect.
It is our understanding that said submitted plan is the
plan that will be placed on record, and on the basis of
the submitted incorrect drawing a permit may be issued.
Until a corrected plan is submitted to your office and
to us, we object to the existing submitted proposal.

Dear Ms. Barrett:
It is our understanding that the ammended plan submitted
by Outer Banks Marine Construction, dated August 17, 2000,
and the survey by Powell Surveying Company, dated August
24, 2000, are now the basis for CAMA to issue a permit.
If this is so, we do not object to the attached proposal
showing a 15 foot setback. We do not under any circum-
stance waive the 15 foot setback requirement on the west
side of 145 Pond Drive, Lot 38, Block 19, Atlantic Beach
Isles.
