This permit is subject to compliance with this application, site drawing
and attached general and specific conditions. Any violation of these terms
may subject the permittee to a fine, imprisonment or civil action; and
may cause the permit to become null and void.
This permit must be on the project site and accessible to the permit of-
ficer when the project is inspected for compliance. The applicant certi-
fies by signing this permit that 1) this project is consistent with the local
land use plan and all local ordinances, and 2) a written statement has
been obtained from adjacent riparian landowners certifying that they
have no objections to the proposed work.
In issuing this permit the State of North Carolina certifies that this project
is consistent with the North Carolina Coastal Management Program.

I received an application this week from Mrs. Beth K. Grogg which states she would
like to build a pier on lot five in Swans Bluff. This is located at 219 Wild Oak Dr. in
Swansboro, NC. I received a similar application approximately three years ago for the
owner of lot three. Wanting to be a good neighbor, I immediately signed the application
and returned it to the owner. A few months later, I made a trip to Swansboro and to my
surprise, found a pier stretching across my property to the point I could have never put a
pier on my property without encroaching on my neighbor's property on lot five. I'm sure
if you check with your colleges they will remember this situation. The pier was build by
Scott Grafton without the proper permit. A year later, I was still trying to get this matter
resolved through your office. Fortunately for me, Fran and Bertha took care of my
problem and the pier was never reconstructed.
I want to cooperate in every way possible so Mrs. Grogg can build her pier however, I
do not want a repeat of this unfortunate situation. I plan to retire in a few years and will
most likely build in Swans Bluff. I plan to construct a pier from the center of lot four
approximately ninety feet straight out. If your office approves, I would like a platform
(deck) and a boat lift on the end of my pier. Keeping this in mind, I have no objections
with the construction of Mrs. Grogg's pier, providing it does not prevent me from
constructing my pier as noted above, at a later late. If you have any doubts or questions

580-3493 (cell). If necessary, I will be glad to meet with you on the site to discuss. I do
not want to hold up this project for Mrs. Grogg but, I do think it is important to have a

This correspondence is in reference to your letter of April 26. 2000 whereby you voiced
concern over a pier and boatlift project by your neighbor Ms. Beth Grogg. The
proposed project site is located on the White Oak River, at 219 Wild Oak Drive in Swans
Bluff, in the Town of Swansboro, Onslow County. The project involves the construction
of a 4' X 73' pier with a 12' X 15' "L" shaped platform and a 10' X 12' boatlift. The
pier would extend out into the water some 60 feet.
The North Carolina Division of Coastal Management has given your concerns careful
consideration and has determined that the Grogg project is consistent with the pertinent
regulations of the Division. Therefore, the Division issued CAMA General Permit
#25547-C to Ms. Grogg on May 10, 2000. The issuance of this permit should have no
affect on your ability to get a permit for your own pier. When are ready to pursue a
permit for construction of your pier please contact this office and a field representative
would be more than happy to -assist you.
If you wish to appeal the Grogg permit decision, you may file a request with the
Director of the Division of Coastal Management, Department of Environment and
Natural Resources within 20 days of the permit decision. If you have any questions
regarding this matter, please don't hesitate to contact me at my Morehead City Office
