RE: General Permit No. 46546
Proposal to install an 8" diameter sewer force main on the west side of US Highway 13
across the White Oak Swamp
D; ar Mr. Cooke:
The Division of Coastal Management has reviewed correspondence from you. dated 30
March 2006, objecting to the above referenced project. The proposal to install an 8" diameter
sewer force main on the west side of US Highway 13 across the White Oak Swamp is consistent
with North Carolina Administrative Code 07H.2400 (See Attached). The project as proposed is
consistent with the appropriate rules and regulations of this Division. Therefore, on 11 August
2006, R. Kelly Spivey, a member of my staff, issued CAMA/Dredge and Fill General Permit No.
46546 in Bertie, authorizing the aforementioned project, (see attached copy of permit).
If you wish to appeal this permit decision, you must file a request with Mr. Charles Jones.
Director of the Division of Coastal Management, Department of Environment and Natural
Resources at 400 Commerce Avenue, Morehead City NC 28557, within 20 days of the permit
decision. (Appropriate forms are available at the Washington Regional Office). Please do not
hesitate to contact me at (252)-948-3851 with any additional questions you may have regarding
this matter.
Sincerely,
-

DEAR MR MOORE:
REPLYING TO YOUR LETTER DATED MARCH 27, 2006 REGARDING CONSTRUCTION AT WRITE OAK
SW'MF, I DO NOT HAVE OBJECTIONS TO THE CONSTRUCTION ON THE WEST SIDE Or H-w'Y 13,
AS SHOWN ON A DRAWING DATED MARCH 2, 2006. I OWN THE PROPERTY ON THE NORT-EAST
SIDE OF US HWY 17; WHICH I BELIEVE IS NOT AFFECTED. IN YEARS PAST I C_rCK;'i THE
RECORDS IN BERTIE COUNTY AND DID NOT FIND ANY RECORD OF US HWY 13 RIGHT OF WAY
OTHER THAN WHAT WAS TAKEN WHEN THE ROADS WERE TAKEN BY THE HIGHWAY DEP.ARTr2!'T,
WH 7 CH WERE APPROXIMATELY THIRTY FEET IN WIDTH. THE MAP I HAVE INDICATES 0\---
HUNDRED FEET RIGHT OF WAY. IF YOU KNOW THE BOOK AND PAGE WHERE SUCH IS RECORDED,
OR SOMETHING OTHER THAN THE WIDTH OF THE HIGHWAY; WHICH I BELIEVE TO BE THIRTY
FEET, PLEASE ADVISE. I DO NOT OBJECT TO THE CONSTRUCTION ON THE WEST SIDE OF THE
HIGHWAY, BUT I DO OBJECT TO THE CLAIM OF THE ONE HUNDRED FEET RIGHT OF WAY OF
HIGHWAY 13 AS SHOWN ON THE DRAWING OF THE AREA AT WHITE OAK SWAMP.
AWAITING YOUR FURTHER ADVICE, I AM
YOURS VERY TRULY
W L COOKE
