Easley, Governor James H. Gregson, Director William G. Ross Jr., Secretary September 11, 2007 Ms. Kay Beaudett 137 Clinton Street Delaware City, DE 19706 Re: Objection to the Issuance of CAMA General Permit No. A49637 for a Development Project including the construction of a bulkhead, pier with platform and boatlift, at Lot 84, 102 Adams Ct., of Heritage Shores in Hertford, NC Dear Ms. Beaudett: This letter is in response to your objection as an adjacent riparian property owner to a permit request from Leo Orenstein for the development of a bulkhead, pier with platform and boatlift in Hertford, Perquimans County. Ms. Holley Snider, of the Division of Coastal Management staff, was recently on site to evaluate the permit applicant's request. The permit applicant has requested a permit to construct a new, 150-foot wooden bulkhead, a 105-foot by 6-foot pier with a 20-foot by 20-foot platform and a 12-foot by 13-foot boatlift. Under the Coastal Area Management Act (CAMA), the Coastal Resources Commission (CRC) has established Rules for General Permits for this type of development that are found in 15A NCAC 07H.100 and 07H.1200. You have notified the Division of Coastal Management of your objections to this proposed development by the submittal of the Adjacent Property Owner Notification/Waiver Form. Your objections to this proposed development related to the construction of the bulkhead and wetland fill. No wetland fill is either proposed by this request or authorized. The Division has reviewed your objections, along with all aspects of this development proposal for consistency with the aforementioned Rules, which describe the CRC's standards and guidelines for this type of development. Our review of the proposed development has found it to be consistent with these Rules. After having given careful consideration to your objections to this proposed development, we have determined that it is consistent with the Rules of the CRC and the State's Coastal Management Program, and that all pre -requisites have been satisfied. Therefore, the Division of Coastal Management issued General Permit No. A49637 on September 11, 2007 (copy attached) for the proposed development. 1367 U.S.17 South, Elizabeth City, North Carolina 27909 Phone: 252-264-3901 1 FAX: 252-264-3723 \ Internet: www.nccoastalmanagement.net An Equal Opportunity 1 Affirmative Action Employer — 50% Recycled 110% Post Consumer Paper Ms. Kay Beaudett September 11, 2007 Page 2 If you wish to appeal this permit decision, you must file a Third Party Hearing Request Form with the Director of the Division of Coastal Management within 20 days of the permit issuance date. If you choose to pursue an appeal, please contact this office so that we can provide you with the appropriate forms and addresses. If you have any further questions regarding this matter, please do not hesitate to contact Ms. Snider, or me, at this office. Sincerely, Frank A.
