Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

We have received notice from Marion T. Noe of their plans to add a pier and driveway to a lot (104 W erview
Lane) adjacent to our house at 397 Oak Hammock Drive on Harkers Island. We lived at Oak Honmocull time
from 1981 to 2000 and still consider Harkers Island home although we currently live off and the-housia sjust a
part-time residents now. My point being we are not your average ding batter (although we do not deny,being
ding batters) as we are very familiar with this specific location and it's recent history. We built the first pier along
this shore. It is currently 245 feet long as I recall. At the time, shrimping was a still a major industry anchrimp
boats of all sizes would come out of Westmouth bay and cut down the shore just past the point-(EagleMock).
This kept a fairly substantial channel parallel to the shore at a point just a few feet from the `end of our. er. The
shrimpers used our property as a landmark know as the glass house.
We are not specifically concerned about the neighbor building a pier and boat lift. We are concerned about the
length of the pier. The document sent us leaves out a critical point as it does not really indicate exactly 350 feet
from where so it is unknown exactly how far out the pier would extend into the water bUt 350 feet is over a
r1Ui1dred feel longer then our pier. Ever, if the channel has shifted, we feel this is way tuo long to justify and may
impact access to our facilities as well as boat traffic.
We would be less likely to object to a pier which did not extend farther out into the water then our pier. We
would however object to any pier if it was constructed in the so called break -away type that are designed to
come apart in sections during hurricanes. At least two of our neighbors to the east have this type of pier and the
sections move down the shore not only reeking havoc with our pier and seawall, but with structures in our yard.
We have pictures made from the last storm before the neighbors collected their pier sections from our property
which clearly shows the damage these sections cause.
We are surprised CAMA regulations would allow a sand drive way over the marsh grass on that lot. That being
said we would not be opposed to our neighbor putting in a driveway of some sort so long as it does not cause
water to back up or stand on our property. Our well and well house is located on the west side of our lot. We do
not want our well contaminated. Unfortunately this lot is the lowest point along this part of the shore.
Historically, it has served as a natural conduit for excess rain, tides and storm wash between the Straits and the
tidal marsh. If the area had been properly managed during it's development, this lot would have never been
sold as a lot and should have been designated as a natural area for reasons I have just mentioned. Of course
that type of management or consideration didn't exist in the 70's and that is history but the facts and nature of
this property still remain the same regardless. Having said all that, I don't know what type of driveway could be
put in that would preserve the current natural storm/water recovery system the property serves and not cause
long term standing water to set on our property and endanger our well, but if such a driveway could be
constructed, we would have a hard time opposing it.
