violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become

This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .

receiving such a permit, I will be responsible for the removal of remnants of all or
Porti y damaged sandbags, and that the sandbags may remain in place for
two ve years after the date of permit approval. Once the temporary erosion
CO2 s Lee (sandbags) is determined to be unnecessary due to the relocation or
removal of the house, the bags must be removed within 30 days.
I also understand that the removal of the sandbags shall not be required if they are
covered by dunes with vegetation sufficient to be considered stable and natural two
years from permit approval date.

Thanks again for coming out to meet with us yesterday. It was greatly
appreciated.
We took some elevation shots this morning, and a graphic (to scale)
indicating the elevations is attached.
The key findings are as follows:
- The toe of the dune escarpment on the ocean side was used as our
reference point.
- The lowest elevation in the dune trough between the dune crest and the
foundation of the house is only .66 ft.higher than the toe of the dune
escarpment. ,
- The lowest elevation in the dune trough is located approximately 50
ft. away from the foundation of the house. The elevation rises by 3.48
ft. over the 50 ft distance before you reach the foundation of the
house, which is a total of 4.14 ft. higher than the toe of the dune
escarpment.
- The street (Inlet Drive) is only 2.0 ft. higher than the toe of the
dune escarpment. I would add that there are several lower spots around
the street and in other homes' front yards that are likely lower than
the toe of the dune escarpment (the street is elevated to some degree).
Ideally, we would like permission from DCM to install sandbags now or at
any time in the future as the dune escarpment migrates toward the home.
In reality, we might wait until the escarpment is closer to the home -
Jim's comments about the one-shot nature of sandbag permits and the fact
that water could make its way behind that sandbags is a good one that
the Murphreys and others should consider carefully.
Do you think this data, along with the rapid erosion rates, enable you
to administratively issue a permit for sandbags - either at the current
location of the dune escarpment or at some other pre -determined location
near the existing remaining dune? (The indication of a pre -determined
location would enable the Murphreys to essentially have the sandbag
contractor ready to go to install sandbags ahead of time, and could save
some valuable time.) Depending on your answer to this question, the
Murphreys may also seek a licensed surveyor to prepare information for a
potential variance request, and they'd try to have that done early next
week to be ready for next Thursday's submission deadline.

Any storm that gets within a few hundred miles of Emerald Isle will raise
the water level and have a catastrophic effect on our dunes and the point
area. The loss of the last 24 feet occurred on full moon or new moon or any
east or northeast wind, but was not storm related.
We desperately need a master permit in place that will allow property
owners in the affected area to place sand bags when the erosion is within
100 feet of our homes.
In the event of a hurricane, it is possible we could loose all of our sand dunes
before we could have time to react or recover.
"An ounce of prevention is worth a pound of cure " certainly applies here!

Please accept this letter as the Town of Emerald Isle's official comments on the "10 -Year Maintenance Dredging
Project Plan for US Coast Guard Station, Emerald Isle, NC". We appreciate the opportunity to offer these
comments to your agencies.
The Town of Emerald Isle supports the efforts of the US Coast Guard and the US Army Corps of Engineers to
provide safe and reliable navigation routes for the Coast Guard and the boating public in the Emerald Isle area.
We are grateful that the Coast Guard has maintained its station in Emerald Isle and greatly appreciate their
contributions to our boating and land-based communities. The Town supports the proposed dredging, and looks
forward to its completion.
The Town offers the following comments for consideration, and requests that these issues be addressed in any
formal plan:
• The proposed dredging work should be completed by a hydraulic pipeline dredge with the capability of
placing the sand on the beach. This type of dredging is more cost-effective in the long run (keeping the
channel open longer) and also enables the beneficial use of dredge spoils on the beach.
The new beach disposal plan should include the flexibility to place the sand on the beach in an area
directly adjacent to The Point on the inlet shoreline, on the oceanfront beach within 1000 ft. of the inlet,
and in the previously authorized 5,800 linear ft. oceanfront disposal area. A map indicating this entire
area is attached. The Town would like the flexibility to direct that the Corps of Engineers place these
dredge spoils at whichever location in this area would provide the maximum storm protection and
recreational benefits at that particular time,
It should be noted that the Town is funding a comprehensive Waterbird Management Plan implemented
by the NC Wildlife Resources Commission. The primary goal of this plan is to protect habitat for
endangered and threatened species and other valuable waterbird species. The current implementation of
this plan should offset any concerns regarding the placement of the dredge spoil material directly on the
inlet shoreline or on the oceanfront beach within 1000 ft. of the inlet. Additionally, the window for this
work is expected to be between November 15 and April 30 of each year, which should further mitigate
any waterbird concerns in these areas.
Care should be taken to insure that any dredging activities do not discourage the stable location of the
main inlet / ocean bar navigational channel in Bogue Inlet, The Town of Emerald Isle invested a
significant sum of money to relocate the main inlet / ocean bar navigational channel in 2005, and has
requested that future Corps of Engineers' dredging activities encourage the stable location of this channel
as much as practical. The proposed location of the Coast Guard dredging would not appear to impact the
main inlet / ocean bar navigational channel in any significant way, however, the Town requests that the
Corps and the Coast Guard consider this issue in formulating plans.
In closing, the Town reiterates its support for this project, and expresses its sincere appreciation to the US Coast
Guard and US Army Corps of Engineers for their efforts to protect and benefit the Emerald Isle area.

Town Continues to Monitor 1,000 Linear Ft. Erosion Area Closely
It's now been 27 months since the Town completed a project that relocated the main
channel in Bogue Inlet approximately 3,500 feet west of The Point shoreline in
Emerald Isle.
I' The new channel continues to maintain depths of 10 -25 feet throughout, and has
needed significantly less maintenance than in the past. This has been particularly
good news due to the continued challenges to secure Federal funding for periodic

' The beach directly at The Point adjacent to the inlet has accreted by nearly 1,000
feet since 2005, and continues to grow. This predicted natural accretion was the
primary goal of the Town's project, which also nourished about 4.5 miles of
' oceanfront beach in central and western Emerald Isle. The Town is extremely
pleased with this result.
Another positive result of the project is the significant accretion that has occurred on '
the eastern tip of Hammocks Beach. A continuous shelf of inter -tidal sand
approximately 2,500 feet long is now in place between the new main channel and
Bear Island. This area is a popular spot for boaters and their families to enjoy the ,
sun, sand, and surf.
The Town has been engaged in rigorous environmental monitoring of the project
before and after its completion, and there have been no detrimental environmental
impacts whatsoever.
The Ione outstanding concern is the erosion of the vast dune field along an
approximately 1,000 linear ft. stretch of oceanfront beach directly east of The Point.
This area has experienced approximately 400 ft. of erosion since Hurricane Ophelia
in September 2005. This dune field was once as much as 800 ft. wide, and the
approximately 15 homes in this area are now protected by a dune field that is
approximately 100 -150 feet wide. Although this erosion is disturbing, fortunately no
existing homes are imminently threatened by the erosion.
This erosion is a result of two key events that have occurred over the past 2+
years. The Town's relocation of the main inlet channel in April 2005 has likely
contributed to the erosion in this area, however, this impact was predicted to not
threaten any homes. The other key event was the reopening of the Coast Guard
channel during Hurricane Ophelia in September 2005. The reopening of this channel
by the storm was not anticipated, and allowed significantly more tidal flow to impact
this area. Because offshore sand shoals are moving ashore as a result of the
relocation of the main inlet channel, this migration of sand has been "pinching"
what's left of the old, Coast Guard channel up against the beach in this area,
resulting in the erosion.
The Town believes that this erosion will resolve itself naturally as a wide lobe of sand
on the oceanfront just east of Channel Drive walkway gradually migrates west down
the beach, as predicted, and as has been occurring in recent months. This
migration, along with the continued migration of offshore sand shoals toward the
beach, is expected to result in the cessation of oceanfront erosion in this area.
Recent detailed underwater surveys and aerial photography also illustrate that the
old, Coast Guard channel is in the process of closing off in this area, which will aid in
the recovery process.

The Town remains concerned about this issue, and is monitoring the situation
closely. The Town is attempting to fill in low spots in the remaining sand dunes to ,
provide additional storm protection for this area, and is currently working through
permitting issues.
