Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythatthis project is consistentwith the North Carolina Coastal Management Program.

Dear Mr. Kwaak:
I will not agree to waive my right to a 15' setback from the property line for
proposed ticket booth on the town property at the Town o Beaufort dock adjacent tom /�
waterfront property at 611 Front Street (next to BB&T).

With•,regard to your proposal, I have the following objections:
1. The large booth extends and occupies almost all of the setback area,
eliminating the open space.
2. Since you are removing the existing small ticket booth on the East side of the
dock, there is no compelling reason or hardship on you not to replace the
existing booth with your proposed larger structure.
I served on the Beaufort Planning Board over half a century ago . Even then, one
of our mandates was to control, prevent, or minimize the construction on the sound side
of Front Street. I believe this is still a worthy objective though obviously conditions have
dramatically changed.
I am sure these concerns continue both with the Town and its citizens.
Consequently, the opening of your ticket booth directly on the sidewalk requires careful
review, considering the large number of people involved on your tours. Congestion on
the sidewalk will range from inconvenient to intolerable. These crowds cannot be
compared to the limited activity at the smaller ticket booths now operating on the
waterfront sidewalk.
Historic compatibility of size, design, and placement will require careful scrutiny
by the Town and may well open consideration to placing the structure out further from
the sidewalk with appropriate widening of the dock or in -filling the approach. This could
all be done on the East side. The result could be an attractive asset both for the Town as
well as your operation. Possibly you could work with the Town in investing in a joint
development with benches, planting, and pleasant standing room.
