Ms. Tere Barrett WrGh+916d QtY DCM Division of Coastal Management 400 Commerce Dr. Morehead City, NC 28557 Dear Ms. Barrett: Enclosed is an application to construct a dock at the mouth of Tusk Creek at 198 Pasture Point Lane in Smyrna, NC. Cullen Cooper and I have entered into a contract to purchase this property contingent upon obtaining a suitable dock permit from CAMA. We greatly appreciate the information we received from you last Thursday concerning placing a dock within the primary estuary zone within this creek. The original dock site that we picked might have met the requirements for such a zone but we felt it was not worth potentially wasting your time to check it out. Instead, we have chosen a site off the end of this peninsula which extends well beyond the demarcation line for the primary estuary. This location would require a dock 260 feet in length with the last 60 feet accessing deeper water at the mandated rate of 1 foot of depth per 100 linear feet of dock. I have enclosed what I believe to be all the necessary information and drawings to apply for this permit. In addition, I have placed 3 PVC pipes with orange painted tops in the water along the dividing line between protected and non -protected areas. I have also installed 4 larger non painted PVC pipes to represent the general line of the dock. I thought this might help you better visualize the proposed project. Thank you in advance for your attention in this matter. If there is anything we can do to help or if any information is missing I trust you will let us know. My understanding is that it may be 4 weeks or so before we hear from you regarding this request. If it is possible, I would appreciate someone from your office letting us know if this process will extend beyond May 30th as this is our currently scheduled closing date for the property.
