Pigott NC Division of Coastal Management SEP 0 8 1998 Hestron II Plaza 151-B Highway 24 Morehead, NC 28557 Reference: Your telephone call on August 11, 1998 and your telephone message on August 31, 1998 When we spoke on August 11, you said that you had received a complaint from Mr. Edmonston that I was not in compliance with my permit application. I disagreed with your assessment and requested that you come by and explain exactly where I did not comply. The Certification of Exemption from Requiring a CAMA Permit, which both you and I signed on May 6, 1998, specifies only two measurements - the first of which is that the boat lift be 12 feet by 12 feet, which it is, and the second is that the boat lift be 5 feet + (plus) from the Edmonston property line, which it is. Since these are the only measurements mentioned, and I have complied with the Certification of Exemption specifications, I am not in violation. I further requested that you call me before you come to ensure that I am here. You said that you would try. On August 31, you called and left a message asking me what I had done about the boat lift. I have been waiting for you to come by and explain exactly what you want me to do. As of this date I have not received a complaint (either verbal or written) from anyone regarding the boat lift. As a matter of fact, if the issue is whether or not the lift interferes with the boat ramp, it does not. I have launched and retrieved my boat from this ramp with a large shrimp boat moored on the opposite side of the marina basin without any difficulty. Neighbors on both sides of my property have both launched and retrieved their boats from the same ramp without difficulty (See attached affidavits). In June, 1998, you yourself looked at the completed boat lift and made no comment. If there is an issue about the easement use by Mr. Edmonston of the boat ramp, this is a civil issue and not subject to CAMA purview.
