The proposed project to be located and constructed as described
above is hereby certified as exempt from the LAMA permit re-
quirement pursuant to 15 NCAC 7K .0203. This exemption to
CAMA permit requirements does not alleviate the necessity of
your obtaining any other State, Federal, or Local authorization.

This certification of exemption from requiring a CAMA permit is
valid for 90 days from the date of issuance. Following expiration,
a re-examination of the project and project site may be necessary
to continue this certification.

Any person who proceeds with a development without the con-
sent of a CAMA official under the mistaken assumption that the
development is exempted, will be in violation of the CAMA if there
is a subsequent determination that a permit was required for the
development.
The applicant certifies by signing this exemption that (1) the ap-
plicant has read and will abide by the conditions of this exemp-
tion, and (2) a written statement has been obtained from adjacent
landowners certifying that they have no objections to the
proposed work.

I have attached to permission for you or your mother to
build a retaining wall on your lot 99 at Bar Harbor which is
adJAcent to MY 10t #10. You also have my permission to use
the unimproved road on my property to access your lot with
the trucks carrying the rocks. However, I ask you to please
be sure the trucks do not tear up the road bed. When we
build we do not intend to have our access road where it is
now located. We plan to have the road on the east side of
our lot. I need to have CAMA approval to add fill to any
part of my property and I do not yet have that approval.
Consequently, if the trucks tear up the roadbed and leave
deep tracks, I have no assurance I will be able to add fill
at a later time. Please ask the trucks to use logging mats
or some other device to prevent excessive damage to the
existing road_
I will soon have a statement from CAUA about wether or not I
can add fill - maybe before your truck activity starts,
Anyway, please let me know before you start to bring in the
trucks.
I have recently had my lot surveyed. The property line is
further to the East than I had thought. I had marked some
beetle killed trees with green ribbon for cutting. Now I
find these trees are on your property. Please consider
having these trees removed as they could blow down causing
further damage and erosion as the root systems will be
pulled up when the trees fall.
I am sending the original permission to you by trail.
