Box 6877 South Brunswick, NC 28470 Dear Mrs. Harris: �& NCDENR NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES MAR 19S8 This is a follow up to my telephone call to you with regard to your letter of January 22, 1998 which outlined several concerns that your organization has with the permitting activities in Sunset Beach, Brunswick County. Your item 1. refers to CAMA permit # 36 which was issued in 1978 for the installation of a sewer line to serve the island. Although the major condition on the face of the permit limits development to 15,000 s.f. lots our most recent interpretation has been that lots which exceed the 15,000 s.f. size may be developed for multi -family as well as single family in excess of 4 bedrooms. The Town has informed us that their ordinances allow for the combination of small lots into larger lots which has been done in this case and we do not anticipate that we will challenge that position. The CAMA has no control over impervious coverage outside of the Estuarine Shoreline AEC. We will continue to examine the permit applications submitted by the Town to monitor compliance with permit # 36. Your item 2. is a matter for the Division of Land Quality and I understand that their staff will examine the situation in the very near future if ,in fact, they have not already done so. Your item 3. involves a situation where, as we understand,a request has been made to develop the property. Although it is our understanding the property owner has been told that the proposed project is inconsistent with the regulations, we, or the Town, cannot refuse to process a permit application. This in noway implies a permit will be issued, it is necessary in order to ensure the applicant has been afforded due process in the event an appeal or a variance request is made. Your item 4. is similar to item 3 above. Again, CAMA cannot refuse to accept and process an application but of course not every one receives a permit. Mrs. Jan Harris February 19, 1998 page 2 Your item 5. has been investigated by me and several members of my staff. Apparently the combined lots did not offer enough room for the installation of a septic tank system with a required repair area, in addition to the storm water infiltration system which our regulations now allow. I asked our District Planner to review the Land Use Plan for Sunset Beach for her opinion concerning the off -site location of the septic tank. Based on her evaluation of the language concerning the subject, I have determined that the wastewater treatment provided with the project is consistent with the Land Use Plan. As I understand the pending Land Use Plan will further clarify the use of off -site septic tanks. In addition the Local Permit Officer/Building Inspector issued the permit for this project in October of 1997 and he considered the project consistent with the Land Use Plan. Your item 6. raises a point that I am bringing to the Town's attention to recommend that they consider your suggestions concerning the permit issuance. Your item 7 we feel is a local situation. Although our regulations address the protection of vegetation located directly on dunes from mechanical damage resulting from bull dozing or sand placement, we do not protect the area which seems to be depicted in the two photographs you submitted with your letter. Neither do our regulations prohibit the cutting of vegetation in any location. During our telephone conversation we also discussed the elimination of the local ordinance dealing with wetland alteration. The CAMA consistency program as well as the permit requirements for wetland action will still provide protection for significant federal wetlands and all coastal. wetlands.
