BOX 1890 WILMINGTON, NORTH CAROLINA 28402-1890 IN REPLY REFER TO July 28, 1998 Regulatory Division Action ID No. 199801618 Mr. William Stone 912 Griffis Street Cary, North Carolina 27511 Dear Mr. Stone: AUG 2 4 1998 This letter confirms the May 29, 1998, receipt of information submitted by the North Carolina Division of Coastal Management (NCDCM), regarding Department of the Army (DA) permitting authority for installation of a fence along your property line approximately 20 feet from the Mean High Water mark. The project is located on Stewart Drive, adjacent to Whitehurst Creek and The Straits, Beaufort, Carteret County, North Carolina. Upon the review of the plans, it has been determined that the activity does not require DA authorization provided the installation of the fence is conducted in accordance with the submitted plans and that no excavated or fill material is placed, pushed, or allowed to erode into the waters and wetlands of The Straits. Any activity taking place outside of these areas should be reviewed by our office. Unauthorized activities within waters or wetlands would be considered a violation of Federal law. This determination does not relieve you of the responsibility to obtain any other required local, State, or Federal approvals. Prior to conducting the activity, it is strongly recommended that you contact Mr. Charles Pigott of NCDCM, at telephone (919) 808-2808, for the required State consistency determination. Thank you for your time and cooperation in this matter. If you have any questions or comments, please address them to me at telephone (910) 251-4811.
