This letter confirms that on May 22, 1998, Charles Pigott and I from this office met with
WAYNE McDEV1TT you and your contractor, Mr. Roy Staebler, onsite your property at 11303 Inlet Drive in
..SECRETARY -
Emerald Isle. Mr. John Yost with the Emerald Isle Inspections Office was also in
attendance. The purpose of our site visit was to address the severe erosion problems that
are occurring on the aforementioned lot.

DIRECTOR From our site inspection, it appears that the erosion escarpment has moved to within 19'
of the foundation of the structure. Therefore, based on 7H.0308(a)(2)(B) of the North
Carolina Administrative Code, your structure is considered imminently threatened and a
candidate for the installation of a temporary erosion control structure. As we discussed
on site, temporary erosion control structures shall be limited to sandbags placed above the
mean high water and located parallel to the shore.
During the site visit, you requested a permit to install the sandbags. We discussed the
steps that you and/or your contractor needed to take before authorization could be granted
including obtaining Federal authorization for the project. We also discussed that these
sandbags would be temporary and could stay in place for up to two years after the date of
approval unless covered by dunes with vegetation sufficient to be considered stable and
natural. I must also emphasize that the property owner is responsible for removal of the
temporary structure within 30 days of the end of the allowable time period.
I also understand that Mr. David Franklin with the U.S. Army Corps of Engineers has
been notified of the situation and is proceeding with the Corps authorization. Once you
have taken the appropriate steps to notify adjacent riparian landowners, please contact
either me or Mr. Pigott for State approval. If you have any questions regarding this
