violation of these terms may subject the permittee to a fine,
imprisonment or civil action; and may cause the permit to be-
come null and void.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
The applicant certifies by signing this permit that 1) this pro-
ject is consistent with the local land use plan and all local
ordinances, and 2) a written statement has been obtained from
adjacent riparian landowners certifying that they have no
objections to the proposed work.

Attached is General Permit #018504-C granting authorization to Pamlico County for the
installation of approximately 220' of water line within the Estuarine Waters, Estuarine Shoreline,
Public Trust Areas and Coastal Wetlands Areas of Environmental Concern (AECs). The project
is located on the North Prong of Bay River, off SR 1002, in Bayboro, Pamlico County.
Please make note of the conditions associated with this permit. This includes the
conditions that are stated on the permit as well as those attached to the 711.1600 regulations and
the NCDOT Encroachment Contract. Also, please make sure that your consultant and contractor
are aware of these conditions. In order to validate this permit, please sign all three (3) copies as
indicated. Retain the white copy for your files and return the yellow and pink signed copies to us
in the enclosed, self-addressed envelope.

SUBJECT: Encroachment Contract - The County of Pamlico

Attached hereto, for your files, is a copy of the Right of Way Encroachment
Contract which has been properly executed. This contract covers the following:
Installation of approximately 1.1 miles of 12" PVC water line along SR 1002
including a road bore under SR 1203; also 1 fire hydrant and appurtenances
shown on the attached plans.
APPROVED SUBJECT TO:
(1) Notify the District Engineer's Office in New Bern (919) 514-4716 prior
to beginning and upon completion of work.
(2) Workmanship and materials to conform to D.O.T. standards and
specifications. Use of Class 200 minimum strength PVC pipe required.
(3) Contact the appropriate Utility Company(ies) involved and make
satisfactory arrangements to adjust the utilities in conflict with the
proposed work prior to construction.
(4) Any pavement or drainage structure disturbed or damaged shall be
restored to its original condition as directed by the District Engineer.

(5) Traffic Control Devices shall be in accordance with the Manual on
Uniform Traffic Control Devices and amendments or supplements
thereto. Proper traffic control devices, signs, etc. shall be installed to
insure public safety.
(6) Trenching, bore pits, and/or other excavations shall not be left open or
unsafe overnight. -
(7) Fill areas/backfill material to be thoroughly compacted to 95% original
density. All trenched material shall be compacted in maximum 6"
layers by mechanical tamp or other previously approved method of
compaction. Any material removed from the trench/pit that is
contaminated or unsuitable for backfill shall be disposed of off DOT
right of way.
(8) Dress, seed and mulch all disturbed areas in accordance with
Attachment #3. This operation to be performed on a weekly basis.
Under no circumstances shall rye grass be allowed (abruzzi or
otherwise) for the seeding of areas within the right of way.
(9) Proper temporary and permanent measures shall be used to control
erosion and sedimentation in accordance with all local, State and
Federal regulations.
(10) When surface areas in excess of one acre will be disturbed, the
Encroaching Party shall submit to the District Engineer a Sediment and
Erosion Control Plan which has been approved by the appropriate
regulatory agency or authority prior to beginning any work on the Right
of Way. Failure to provide this information -shall be grounds for -
suspension of operations.
(11) It shall be the responsibility of the encroaching party to remove all
temporary erosion control measures once a satisfactory vegetative
cover has been established.

(12) All roadway signs are to be replaced at the end of the same work day.
(13) Water mains under all concrete and asphalt driveways, and State
maintained roads within the State right of way crossed by this
construction shall be installed per attachments #1 and #2 entitled
Special Provisions - Untrenched Construction. Any open cut in
contradiction to the -above will be allowed only with written permission
from the property owner.
(14) No open cut of pavement on SR 1002 or SR 1203 will be allowed.
(15) Remain 3 foot minimum or 1 foot distance per 1 foot depth from edge of
pavement whichever is greater for shoulder installations. Remain 5
foot minimum from edge of pavement to edge of bore pit.
(16) Remain 5 foot minimum from the installation to any part of a pipe
culvert. --
(17) Strict compliance with the Policies and Procedures for Accommodating
Utilities on Highway Rights of Way Manual shall be required.
(18) Where pipelines are installed in the right of way and are not of ferrous
material, a locating tape shall be installed with the pipeline.
(19) In cases where less than minimum bury is necessary or where bores
are greater than 6", the pipe shall be protected with a casing.
(20) Hydrants, valves, manholes, and other appurtenances shall be located
-- -- - - --at the -right of way or to not interfere with maintenance activities. All
appurtenances to be located flush with existing ground elevation.
(21) Fire hydrants shall be the break -away type and shall be placed a
minimum distance of 6 feet back of curb and gutter sections and back
of ditch in roadway sections. Where there is no ditch, the hydrant will
be placed as far as possible from the pavement edge within right of

way outer limits.
(22) Due to the nature of the proposed work, the Division Engineer may
assign an inspector to make periodic inspections as the work
progresses, the cost of which shall be borne by the encroaching party.
(23) The Department of Transportation does not guarantee the right of way
on these roads, nor will it be responsible for any claim for damages
brought by any property owner by reason of the installation.
(24) No portion of the right of way shall be used for parking equipment
during construction.
(25) A $10,000 Performance Bond shall be submitted to the District Office
prior to beginning of work.
(26) Upon completion of the work, the utility owner shall submit an "as built"
set of plans to the District Engineer's Office which shall include
accurate information as to the horizontal distance to the facility from
edge of main travel way and general depth in relation to existing
natural ground. -

Attached hereto, for your files, is a copy of the Right of Way Encroachment
Contract which has been properly executed. This contract covers the following:
Installation of approximately 1.1 miles of 12" PVC water line along SR 1002
including a road bore under SR 1203; also 1 fire hydrant and appurtenances
shown on the attached plans.
APPROVED SUBJECT TO:
(1) Notify the District Engineer's Office in New Bern (919) 514-4716 prior
to beginning and upon completion of work.
(2) Workmanship and materials to conform to D.O.T. standards and
specifications. Use of Class 200 minimum strength PVC pipe required.
(3) Contact the appropriate Utility Company(ies) involved and make
satisfactory arrangements to adjust the utilities in conflict with the
proposed work prior to construction.
(4) Any pavement or drainage structure disturbed or damaged shall be
restored to its original condition as directed by the District Engineer.

(5) Traffic Control Devices shall be in accordance with the Manual on
Uniform Traffic Control Devices and amendments or supplements
thereto. Proper traffic control devices, signs, etc. shall be installed to
insure public safety.
(6) Trenching, bore pits, and/or other excavations shall not be left open or
unsafe overnight.
(7) Fill areas/backfill material to be thoroughly compacted to 95% original
density. All trenched material shall be compacted in maximum 6"
layers by mechanical tamp or other previously approved method of
compaction. Any material removed from the trench/pit that is
contaminated or unsuitable for backfill shall be disposed of off DOT
right of way.
(8) Dress, seed and mulch all disturbed areas in accordance with
Attachment #3. This operation to be performed on a weekly basis.
Under no circumstances shall rye grass be allowed (abruzzi or
otherwise) for the seeding of areas within the right of way.
(9) Proper temporary and permanent measures shall be used to control
erosion and sedimentation in accordance with all local, State and
Federal regulations.
(10) When surface areas in excess of one acre will be disturbed, the
Encroaching Party shall submit to the District Engineer a Sediment and
Erosion Control Plan which has been approved by the appropriate
regulatory agency or authority prior to beginning any work on the Right
of Way. Failure to provide this information -shall be grounds for -
suspension of operations.
(11) It shall be the responsibility of the encroaching party to remove all
temporary erosion control measures once a satisfactory vegetative
cover has been established.

(12) All roadway signs are to be replaced at the end of the same work day.
(13) Water mains under all concrete and asphalt driveways, and State
maintained roads within the State right of way crossed by this
construction shall be installed per attachments #1 and #2 entitled
Special Provisions - Untrenched Construction. Any open cut in
contradiction to the -above will be allowed only with written permission
from the property owner.
(14) No open cut of pavement on SR 1002 or SR 1203 will be allowed.
(15) Remain 3 foot minimum or 1 foot distance per 1 foot depth from edge of
pavement whichever is greater for shoulder installations. Remain 5
foot minimum from edge of pavement to edge of bore pit.
(16) Remain 5 foot minimum from the installation to any part of a pipe
culvert. -
(17) Strict compliance with the Policies and Procedures for Accommodating
Utilities on Highway Rights of Way Manual shall be required.
(18) Where pipelines are installed in the right of way and are not of ferrous
material, a locating tape shall be installed with the pipeline.
(19) In cases where less than minimum bury is necessary or where bores
are greater than 6", the pipe shall be protected with a casing.
(20) Hydrants, valves, manholes, and other appurtenances shall be located
- - - --- - --at the -right of way or to not interfere with maintenance activities. All
appurtenances to be located flush with existing ground elevation.
(21) Fire hydrants shall be the break -away type and shall be placed a
minimum distance of 6 feet back of curb and gutter sections and back
of ditch in roadway sections. Where there is no ditch, the hydrant will
be placed as far as possible from the pavement edge within right of

way outer limits.
(22) Due to the nature of the proposed work, the Division Engineer may
assign an inspector to make periodic inspections as the work
progresses, the cost of which shall be borne by the encroaching party.
(23) The Department of Transportation does not guarantee the right of way
on these roads, nor will it be responsible for any claim for damages
brought by any property owner by reason of the installation.
(24) No portion of the right of way shall be used for parking equipment
during construction.
(25) A $10,000 Performance Bond shall be submitted to the District Office
prior to beginning of work.
(26) Upon completion of the work, the utility owner shall submit an "as built"
set of plans to the District Engineer's Office which shall include
accurate information as to the horizontal distance to the facility from
edge of main travel way and general depth in relation to existing
natural ground.

operation progresses, each new section.of tiie encasement pipe shall be butt -Welded•
to tfie section previously_�cked into place.. Encasements shall extend from ditch
line to ditch line in cut •sections, 5',beyond the toe of slopes in•fiLl sections,

If voids are encountered or occur outside the encasement. pipe, grout boles shall be*
installed in the top section of the encasement pipe at 10 foot centers and tile. .

In the event an obstruction is encountered during the boring and jacking operation
the auger is to be withdrawn and the -excess pipe is to be cut off, c.Epped, and

before moving to another boring site.

SEEDING AND MULCHING SCHEDULE
The kinds of seed and fertilizer, and the rates of application of
seed, fertilizer, and limestone shall be as stated below unless otherwise
directed by the Engineer. Fertilizer shall be 10-20-20 analysis. A
different analysis of fertilizer may be used provided the 1-2-2 ratio is
maintained and the rate of application is adjusted to provide the same
amount of plant food as a 10-20-20 analysis.
